Acesta poate fi i\u0302ncheiat la orice notar public din Roma\u0302nia.<\/p>\n<p>Pentru a i\u0302ncheia o tranzac\u021bie imobiliar\u0103 proprietarul trebuie s\u0103 de\u021bin\u0103 o serie de documente. Este vorba despre:<\/p>\n<h2>1. Actul de proprietate asupra imobilului<\/h2>\n<p>Fie c\u0103 este vorba despre un contract de va\u0302nzare-cump\u0103rare, de un contract de dona\u021bie, de o sentin\u021b\u0103\/decizie civil\u0103 definitiv\u0103 \u0219i irevocabil\u0103, de un titlu de proprietate sau de un certificat de mo\u0219tenitor, ob\u021binut i\u0302n urma succesiunii la notar \u0219i intabulat i\u0302n cartea funciar\u0103.<\/p>\n<h2>2. Certificat fiscal<\/h2>\n<p>Acest act este eliberat de Administra\u021bia Financiar\u0103 unde se pl\u0103te\u0219te impozitul anual pe imobilul i\u0302n cauz\u0103. Certificatul atest\u0103 faptul c\u0103 proprietarul nu are datorii c\u0103tre Stat. Dac\u0103 exist\u0103 mai mul\u021bi coproprietari, autorit\u0103\u021bile emit certificat fiscal pentru fiecare dintre ace\u0219tia.<\/p>\n<p>Certificatul fiscal se ob\u021bine prin depunerea unei cereri la registratura organul fiscal competent. Cererea poate fi trimis\u0103 \u0219i prin po\u0219t\u0103 (scrisoare recomandat\u0103) sau poate fi i\u0302nregistrat\u0103 prin intermediul serviciului online \u201c<a class=\"article-body-links\"href=\"https:\/\/www.anaf.ro\/anaf\/internet\/ANAF\/servicii_online\/Inregistrare_persoane_fizice\">Spa\u021biul privat virtual<\/a>\u201d.<\/p>\n<p>Documentul este eliberat i\u0302ntr-o perioad\u0103 de 3 zile lucr\u0103toare de la depunerea cererii. <strong>Aten\u021bie!<\/strong> Certificatul fiscal este valabil doar pa\u0302n\u0103 la sfa\u0302r\u0219itul lunii i\u0302n care este emis.<\/p>\n<h2>3. Documenta\u021bie cadastral\u0103 (cadastru \u0219i intabulare)<\/h2>\n<p>Aceasta poate fi i\u0302ntocmit\u0103 doar de c\u0103tre un expert cadastral autorizat.<\/p>\n<p>Lista exper\u021bilor autoriza\u021bi poate fi consultat\u0103 pe <a class=\"article-body-links\"href=\"https:\/\/www.ancpi.ro\/lista-autorizati\/\" target=\"_blank\" rel=\"noopener\">site-ul<\/a> Agen\u021biei Na\u021bionale de Cadastru \u0219i Publicitate Imobiliar\u0103. Tot aici g\u0103se\u0219ti \u0219i datele lor de contact.<\/p>\n<p>I\u0302n medie, documenta\u021bia cadastral\u0103 cost\u0103 700-800 lei pentru un apartament cu 2 camere, sum\u0103 la care se adaug\u0103 o tax\u0103 i\u0302n valoare de 120 de lei care se pl\u0103te\u0219te c\u0103tre Oficiul Cadastral \u0219i de Publicitate Imobiliar\u0103 (OCPI) de la nivel local. Termenul de eliberare este de 18 zile lucr\u0103toare. Costurile cresc la 800-900 de lei, plus 120 tax\u0103 OCPI, i\u0302n cazul apartamentelor cu 3 camere \u0219i 900-1.000 de lei, plus tax\u0103 OCPI, i\u0302n cazul apartamentelor cu 4 camere.<\/p>\n<h2>4. Extras de carte funciar\u0103<\/h2>\n<p>Acest act poate fi ob\u021binut prin intermediul biroului notarial.<\/p>\n<h2>5. Certificat de performan\u021b\u0103 energetic\u0103<\/h2>\n<p>Acest certificat este eliberat doar de c\u0103tre un auditor energetic atestat. Lista auditorilor energetici autoriza\u021bi poate fi consultat\u0103 pe site-ul Ministerului Dezvolt\u0103rii Regionale, Administra\u021biei Publice \u0219i Fondurilor Europene. Aceasta este actualizat\u0103 constant \u0219i cuprinde \u0219i datele de contact ale auditorilor.<\/p>\n<p>Pre\u021bul pentru eliberarea certificatului de performan\u021b\u0103 energetic\u0103 este, i\u0302n medie, de 250 de lei pentru apartamente. I\u0302n cazul caselor, pre\u021bul este negociat, de cele mai multe ori, i\u0302n func\u021bie de suprafa\u021ba \u0219i complexitatea propriet\u0103\u021bii. Certificatul se elibereaz\u0103, i\u0302n general, i\u0302n 24-48 de ore \u0219i are o valabilitate de 10 ani.<\/p>\n<h2>6. Ultima factur\u0103 \u0219i chitan\u021ba aferent\u0103<\/h2>\n<p>Acestea atest\u0103 plata la zi a utilit\u0103\u021bilor.<\/p>\n<h2>7. Adeverin\u021b\u0103 eliberat\u0103 de asocia\u021bia de proprietari\/locatari (doar i\u0302n cazul apartamentelor)<\/h2>\n<p>Aceast\u0103 adeverin\u021b\u0103 atest\u0103 faptul c\u0103 proprietarul nu are datorii fa\u021b\u0103 de asocia\u021bia de proprietari\/locatari, cum ar fi i\u0302nta\u0302rzieri la plata i\u0302ntre\u021binerii, datorii pentru cheltuielile comune, etc.<\/p>\n<p><strong>Aten\u021bie!<\/strong> Adeverin\u021ba trebuie eliberat\u0103 i\u0302n original, trebuie s\u0103 precizeze numele complet al pre\u0219edintelui \u0219i al administratorului asocia\u021biei al\u0103turi de semn\u0103turile acestora \u0219i de \u0219tampila asocia\u021biei.<br \/>\nDac\u0103 proprietarul are datorii pe care nu poate s\u0103 le pl\u0103teasc\u0103, doar cu acordul cump\u0103r\u0103torului, poate fi introdus\u0103 i\u0302n contractul de va\u0302nzare-cump\u0103rare o clauz\u0103 prin care acesta din urm\u0103 i\u0302\u0219i asum\u0103 preluarea lor.<\/p>\n<h2>Ce taxe trebuie s\u0103 pl\u0103te\u0219ti<\/h2>\n<p>Cump\u0103r\u0103torul este cel care pl\u0103te\u0219te onorariul perceput de biroul notarial unde se semneaz\u0103 contractul de va\u0302nzare-cump\u0103rare. Acesta este calculat i\u0302n func\u021bie de valoarea locuin\u021bei.<\/p>\n<h2><strong><a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2018\/03\/model-contract-v\u00e2nzare-cump\u0103rare.docx\">Descarc\u0103 AICI un model de contract de v\u00e2nzare-cump\u0103rare<\/a><\/strong><\/h2>\n<p><em>*Acest document are caracter informativ.<\/em><\/p>\n<p>Taxa de eliberare a extrasul de carte funciar\u0103 de la Biroul de Carte Funciar\u0103 din cadrul Oficiului de Cadastru \u0219i Publicitate Imobiliar\u0103, pe baza c\u0103ruia notarul public poate autentifica un act de va\u0302nzare a unui bun imobil, poate fi achitat\u0103 ata\u0302t de c\u0103tre cump\u0103r\u0103tor, ca\u0302t \u0219i de va\u0302nz\u0103tor, i\u0302n func\u021bie de i\u0302n\u021belegerea lor. Unii va\u0302nz\u0103tori pot fi dispu\u0219i s\u0103 pl\u0103teasc\u0103 aceast\u0103 tax\u0103 pentru a facilita tranzac\u021bia. Valoarea sa este de 40 de lei i\u0302n regim normal.<\/p>\n<p>Tariful de intabulare solicitat de Agen\u021bia Na\u021bional\u0103 de Cadastru \u0219i Publicitate Imobiliar\u0103 este achitat tot de cump\u0103r\u0103tor. Acesta reprezint\u0103 0,15% din pre\u021bul va\u0302nz\u0103rii. Proprietarul trebuie s\u0103 pl\u0103teasc\u0103 impozit i\u0302n urma tranzac\u021biei imobiliare. La v\u00e2nzare imobilului de\u021binut de mai pu\u021bin de 3 ani, proprietarul va pl\u0103ti un impozit de 3% din valoarea bunului. Dac\u0103 imobilul a fost de\u021binut mai mult de 3 ani, impozitul datorat va fi de 1%.
