Proprietarii imobilelor date \u00een chirie se pot reg\u0103si, uneori, \u00een situa\u021bii delicate, pe care mul\u021bi nu \u0219tiu cum s\u0103 le gestioneze. Cu toate acestea, exist\u0103 solu\u021bii legale pentru orice problem\u0103 ap\u0103rut\u0103 \u00een urma \u00eenchirierii unei locuin\u021be, prev\u0103zute chiar \u00een Noul Cod Civil. De\u0219i rezolvarea pe cale amiabil\u0103 este cea mai simpl\u0103 solu\u021bie, aceasta nu este \u00eentotdeauna posibil\u0103.<\/strong><\/p>\n\n\n\n<p>\u00cen cazul \u00een care chiria\u0219ul nu \u00ee\u0219i \u00eendepline\u0219te obliga\u021biile contractuale, po\u021bi cere \u00een instan\u021b\u0103 rezilierea contractului de \u00eenchiriere sau evacuarea chiria\u0219ului. Iat\u0103 ce presupune procedura de evacuare \u0219i c\u00e2nd o po\u021bi solicita.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">C\u00e2nd po\u021bi cere evacuarea chiria\u0219ului<\/h2>\n\n\n\n<p>Po\u021bi solicita evacuarea chiria\u0219ului din imobil \u00een urm\u0103toarele situa\u021bii:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Chiria\u0219ul nu \u00ee\u0219i respect\u0103 obliga\u021biile contractuale (nu pl\u0103te\u0219te chiria sau utilit\u0103\u021bile, nu men\u021bine locuin\u021ba \u00een stare bun\u0103, produce stric\u0103ciuni majore);<\/li>\n\n\n\n<li>Chiria\u0219ul \u0219i persoanele care locuiesc \u00eempreun\u0103 cu acesta au un comportament inadecvat \u0219i \u00eempiedic\u0103 utilizarea normal\u0103 a imobilului sau a spa\u021biilor comune;<\/li>\n\n\n\n<li>Contractul de \u00eenchiriere a expirat, iar chiria\u0219ul nu vrea s\u0103 p\u0103r\u0103seasc\u0103 locuin\u021ba \u0219i nu opteaz\u0103 pentru prelungirea contractului;<\/li>\n\n\n\n<li>Chiria\u0219ul nu elibereaz\u0103 imobilul dup\u0103 expirarea termenului \u00eenscris \u00een notificarea de reziliere sau de denun\u021bare unilateral\u0103 a contractului;<\/li>\n\n\n\n<li>Dac\u0103 imobilul este v\u00e2ndut \u2013 doar dac\u0103 v\u00e2nzarea este men\u021bionat\u0103 \u00een contract precum o cauz\u0103 de \u00eencetare a contractului de \u00eenchiriere;<\/li>\n\n\n\n<li>Situa\u021bii de for\u021b\u0103 major\u0103 (incendii, inunda\u021bii) care impun lucr\u0103ri de repara\u021bii \u00een imobil.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Po\u021bi cere evacuarea imobilului \u0219i dac\u0103 o persoan\u0103 \u00eel folose\u0219te f\u0103r\u0103 drept, prin ocupare clandestin\u0103, f\u0103r\u0103 s\u0103 fi avut vreodat\u0103 un contract de \u00eenchiriere.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ce presupune procedura de evacuare a chiria\u0219ului<\/h2>\n\n\n\n<p>Evacuarea chiria\u0219ului se face doar pe baza unor motive bine \u00eentemeiate \u0219i presupune o serie de pa\u0219i legali:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Notificare scris\u0103: <\/strong>Proprietarul este obligat s\u0103 \u00eel notifice pe chiria\u0219 printr-o soma\u021bie de evacuare, unde sunt men\u021bionate motivele. Acesta trebuie s\u0103 p\u0103r\u0103seasc\u0103 imobilul \u00een termen de 30 de zile. Dac\u0103 dreptul de ocupare a locuin\u021bei a \u00eencetat (expirarea contractului sau termenului de preaviz \u00een cazul denun\u021b\u0103rii unilaterale\/rezilierii), termenul de evacuare este de 5 zile;<\/li>\n\n\n\n<li><strong>Depunerea cererii \u00een instan\u021b\u0103: <\/strong>\u00cen cazul \u00een care chiria\u0219ul nu elibereaz\u0103 locuin\u021ba \u00een termenul prev\u0103zut, proprietarul poate \u00eenainta cererea de evacuare \u00een instan\u021b\u0103;<\/li>\n\n\n\n<li><strong>Emiterea hot\u0103r\u00e2rii judec\u0103tore\u0219ti: <\/strong>Instan\u021ba de judecat\u0103 emite o hot\u0103r\u00e2re judec\u0103toreasc\u0103 de evacuare, dac\u0103 decide c\u0103 aceasta este justificat\u0103;<\/li>\n\n\n\n<li><strong>Evacuarea for\u021bat\u0103: <\/strong>Executorul judec\u0103toresc pune \u00een aplicare hot\u0103r\u00e2rea instan\u021bei. Acesta \u00eel notific\u0103 pe chiria\u0219, iar \u00een situa\u021bia \u00een care chiria\u0219ul nu se conformeaz\u0103, va fi evacuat silit.&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>Potrivit legii, \u00een cazul \u00een care chiria\u0219ul nu elibereaz\u0103 de bun\u0103 voie locuin\u021ba, nu \u00eel po\u021bi evacua dec\u00e2t pe baza unei hot\u0103r\u00e2ri judec\u0103tore\u0219ti.<\/p>\n\n\n\n<p>Cheltuielile de judecat\u0103 sunt suportate de chiria\u0219, iar acesta este obligat la plata chiriei, utilit\u0103\u021bilor \u0219i repara\u021biilor aferente perioadei \u00een care a ocupat efectiv locuin\u021ba.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Drepturile chiria\u0219ului &#8211; ce trebuie s\u0103 \u0219tii<\/h2>\n\n\n\n<p>\u00cenainte de a \u00eenainta o ac\u021biune de evacuare \u00een instan\u021b\u0103, este important s\u0103 cuno\u0219ti care sunt drepturile chiria\u0219ului:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Chiria\u0219ul are dreptul de a se ap\u0103ra \u00een instan\u021b\u0103;<\/li>\n\n\n\n<li>Chiria\u0219ul are dreptul la contesta\u021bia execut\u0103rii silite;<\/li>\n\n\n\n<li>Chiria\u0219ul are dreptul s\u0103 fie notificat \u0219i s\u0103 primeasc\u0103 un termen de preaviz;<\/li>\n\n\n\n<li>Chiria\u0219ul nu poate fi constr\u00e2ns s\u0103 elibereze imobilul, \u00een lipsa unei hot\u0103r\u00e2ri judec\u0103tore\u0219ti;<\/li>\n\n\n\n<li>Chiria\u0219ul nu poate fi evacuat \u00een sezonul rece, mai exact \u00een perioada 1 decembrie-1 martie a anului urm\u0103tor, conform Articolului 896 din Codul de Procedur\u0103 Civil\u0103. Totu\u0219i, exist\u0103 \u00eens\u0103 \u0219i unele excep\u021bii de la regul\u0103. Spre exemplu, evacuarea poate fi f\u0103cut\u0103 dac\u0103 se dovede\u0219te c\u0103 acesta are la dispozi\u021bie o locuin\u021b\u0103 \u00een care se poate muta.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Alte modalit\u0103\u021bi de \u00eencetare a contractului de \u00eenchiriere<\/h2>\n\n\n\n<p>Pe l\u00e2ng\u0103 m\u0103sura drastic\u0103 de evacuare cu un executor judec\u0103toresc, exist\u0103 \u0219i alte op\u021biuni pentru \u00eencetarea contractului de \u00eenchiriere \u00eenainte de termen.<\/p>\n\n\n\n<p>\u00cencetarea contractului de \u00eenchiriere poate fi cerut\u0103 at\u00e2t de c\u0103tre proprietar, c\u00e2t \u0219i de chiria\u0219. Indiferent de motivul pentru care se dore\u0219te \u00eencheierea contractului, trebuie s\u0103 ai \u00een vedere faptul c\u0103 eliberarea locuin\u021bei nu poate fi f\u0103cut\u0103 f\u0103r\u0103 un preaviz.<\/p>\n\n\n\n<p>Potrivit prevederilor legale \u00een vigoare, po\u021bi solicita eliberarea locuin\u021bei astfel:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Denun\u021barea unilateral\u0103&nbsp;<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Se realizeaz\u0103 prin notificare scris\u0103. Poate fi f\u0103cut\u0103 at\u00e2t de c\u0103tre proprietar, c\u00e2t \u0219i de c\u0103tre chiria\u0219, cu acordarea unui termen de preaviz.&nbsp;<\/p>\n\n\n\n<p>\u00cen cazul \u00een care contractul de \u00eenchiriere a fost \u00eencheiat pe o perioad\u0103 determinat\u0103 de timp, proprietarul trebuie s\u0103 ofere un termen de preaviz de cel pu\u021bin 60 de zile.<\/p>\n\n\n\n<p>Dac\u0103 a fost \u00eencheiat pe o perioad\u0103 nedeterminat\u0103 de timp, perioada de preaviz este de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>60 de zile, dac\u0103 intervalul pentru care s-a stabilit plata chiriei este egal sau mai mare de o lun\u0103;<\/li>\n\n\n\n<li>15 zile, \u00een cazul \u00een care intervalul de plat\u0103 a chiriei este mai mic de o lun\u0103.<\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\">\n<li><strong>Rezilierea contractului<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Aceasta poate fi cerut\u0103 at\u00e2t de c\u0103tre proprietar, c\u00e2t \u0219i de c\u0103tre chiria\u0219, numai \u00een cazul \u00een care una dintre p\u0103r\u021bi nu respect\u0103 obliga\u021biile asumate \u00een contract.<\/p>\n\n\n\n<p>Un proprietar poate cere rezilierea contractului prin notificare scris\u0103 sau \u00een instan\u021b\u0103, dac\u0103 chiria\u0219ul sau alte persoane care locuiesc al\u0103turi de acesta:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Nu \u00ee\u0219i \u00eendeplinesc obliga\u021biile contractuale (cum ar fi plata chiriei);<\/li>\n\n\n\n<li>Au un comportament care face imposibil\u0103 convie\u021buirea cu celelalte persoane din imobil sau cu vecinii;<\/li>\n\n\n\n<li>\u00cempiedic\u0103 folosirea normal\u0103 a locuin\u021bei\/a spa\u021biilor comune.<\/li>\n<\/ul>\n\n\n\n<p><a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/imoexpert\/cele-3-moduri-legale-prin-care-poti-iesi-dintr-un-contract-de-inchiriere\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mai multe detalii aici.<\/a><\/p>\n\n\n\n<p>Dac\u0103 \u00een urma denun\u021b\u0103rii unilaterale sau rezilierii contractului, chiria\u0219ul refuz\u0103 s\u0103 p\u0103r\u0103seasc\u0103 locuin\u021ba \u00een termenul stabilit, po\u021bi recurge la procedura de evacuare.<\/p>\n\n\n\n<p>Prin urmare, evacuarea chiria\u0219ului este un proces complex, care presupune respectarea unor etape prev\u0103zute de lege. De aceea, este indicat s\u0103 ceri ajutorul unui avocat.
