E\u0219ti proprietar, iar chiria\u0219ul nu \u00ee\u0219i respect\u0103 obliga\u021biile prev\u0103zute \u00een contract? \u00cen orice situa\u021bie te-ai reg\u0103si, nu po\u021bi elibera locuin\u021ba dup\u0103 bunul plac. At\u00e2t chiria\u0219ii care vor s\u0103 se mute, c\u00e2t \u0219i proprietarii care doresc evacuarea imobilului din diferite motive, trebuie s\u0103 respecte anumite prevederi legale \u0219i contractuale. Iat\u0103 care sunt, a\u0219adar, principalele modalit\u0103\u021bi legale de \u00eencetare a contractelor de \u00eenchiriere.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Expirarea termenului contractual<\/h2>\n\n\n\n<p>Atunci c\u00e2nd acordul a fost \u00eencheiat pe o perioad\u0103 determinat\u0103, cel mai simplu mod de a renun\u021ba la contractul de \u00eenchiriere este s\u0103 a\u0219tep\u021bi, pur \u0219i simplu, p\u00e2n\u0103 la expirarea acestuia.&nbsp;<\/p>\n\n\n\n<p>Potrivit legii, \u00eenchirierea \u00eenceteaz\u0103 de drept la expirarea termenului convenit de p\u0103r\u0163i sau, dup\u0103 caz, cel prev\u0103zut de lege, f\u0103r\u0103 a fi necesar\u0103 o \u00een\u015ftiin\u0163are prealabil\u0103 a proprietarului. Chiria\u0219ul trebuie s\u0103 p\u0103r\u0103seasc\u0103 locuin\u021ba \u00een cel mult 30 de zile de la expirarea contractului \u0219i s\u0103 pl\u0103teasc\u0103 toate cheltuielile aferente perioadei \u00een care a locuit.&nbsp;<\/p>\n\n\n\n<p>De\u0219i chiria\u0219ul are dreptul la re\u00eennoirea contractului, acest lucru nu este posibil f\u0103r\u0103 acordul proprietarului. Acesta din urm\u0103 poate refuza prelungirea duratei de \u00eenchiriere din diferite motive, precum stric\u0103ciuni semnificative ale bunurilor, neplata chiriei \u0219i utilit\u0103\u021bilor, sub\u00eenchirierea f\u0103r\u0103 consim\u021b\u0103m\u00e2ntul s\u0103u. \u00cen aceste cazuri, proprietarul este obligat s\u0103 notifice chiria\u0219ul cu privire la refuzul de a re\u00eennoi contractul, cu cel pu\u021bin 60 de zile \u00eenainte de expirare.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Denun\u021barea contractului<\/h2>\n\n\n\n<p>\u00cen cazul \u00een care nu po\u021bi sau nu vrei s\u0103 a\u0219tep\u021bi p\u00e2n\u0103 la expirarea termenului prev\u0103zut \u00een contract, po\u021bi opta pentru denun\u021barea acordului prin notificare, adic\u0103 printr-o informare scris\u0103 transmis\u0103 proprietarului sau chiria\u0219ului.&nbsp;<\/p>\n\n\n\n<p>Pentru contractele pe durat\u0103 nedeterminat\u0103, Noul Cod Civil prevede c\u0103, \u00een calitate de chiria\u0219, trebuie s\u0103 respec\u021bi un termen de preaviz ce nu poate fi mai mic dec\u00e2t sfertul intervalului de timp pentru care s-a stabilit plata chiriei. Cu alte cuvinte, dac\u0103 pl\u0103te\u0219ti chiria lunar, trebuie s\u0103 anun\u021bi proprietarul cu cel pu\u021bin o s\u0103pt\u0103m\u00e2n\u0103 \u00eenainte de a te muta.<\/p>\n\n\n\n<p>\u00cen aceea\u0219i situa\u021bie, proprietarul poate denun\u021ba contractul, respect\u00e2nd un termen de preaviz ce nu poate fi mai mic de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>60 de zile \u2013 dac\u0103 plata chiriei s-a stabilit la un interval de o lun\u0103 sau mai mult;<\/li>\n\n\n\n<li>15 zile \u2013 dac\u0103 plata chiriei se realizeaz\u0103 la un interval mai mic de o lun\u0103.<\/li>\n<\/ul>\n\n\n\n<p>Termenul de preaviz este \u00eens\u0103 semnificativ mai mare \u00een cazul contractelor \u00eencheiate pe o perioad\u0103 determinat\u0103. \u00cen astfel de situa\u021bii, ai obliga\u021bia de a informa proprietarul cu cel pu\u021bin 60 de zile \u00eenainte de a te muta din cas\u0103. Orice clauz\u0103 (\u00eenscris\u0103 \u00een contract) contrar\u0103 acestei prevederi este considerat\u0103 nescris\u0103.<\/p>\n\n\n\n<p>\u00cen general, chiria\u0219ii care vor s\u0103 p\u0103r\u0103seasc\u0103 urgent locuin\u021ba, f\u0103r\u0103 respectarea termenului de preaviz stipulat \u00een contract, nu \u00ee\u0219i pot recupera garan\u021bia.<\/p>\n\n\n\n<p>Proprietarul trebuie s\u0103 comunice la ANAF, \u00een termen de 30 de zile, orice modificare a contractului de \u00eenchiriere, precum \u0219i \u00eencetarea acestuia.&nbsp;<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Rezilierea<\/h1>\n\n\n\n<p>O alt\u0103 modalitate prin care se poate pune cap\u0103t unui acord de \u00eenchiriere const\u0103 \u00een rezilierea contractului. Dreptul de reziliere revine at\u00e2t proprietarului, c\u00e2t \u0219i chiria\u0219ului, \u00eens\u0103 doar \u00een baza neexecut\u0103rii obliga\u0163iilor contractuale de c\u0103tre cealalt\u0103 parte.&nbsp;<\/p>\n\n\n\n<p>Aceast\u0103 variant\u0103 este folosit\u0103 mai rar de c\u0103tre chiria\u0219i. De regul\u0103, aceasta este luat\u0103 \u00een considerare \u00een urm\u0103toarele situa\u021bii:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>proprietarul \u00ee\u0219i \u00eencaseaz\u0103 chiria pe mai multe luni;<\/li>\n\n\n\n<li>chiria\u0219ul \u00eempiedic\u0103 folosirea normal\u0103 a spa\u021biului de locuit \u0219i a zonelor comune;<\/li>\n\n\n\n<li>chiria\u0219ul are un comportament inadecvat, care face imposibil\u0103 convie\u021buirea cu ceilal\u021bi locatari din imobil sau vecinii.<\/li>\n<\/ul>\n\n\n\n<p>Dezavantajul s\u0103u major este c\u0103, \u00een lipsa atingerii unui consens amiabil \u00eentre cele dou\u0103 p\u0103r\u021bi, conflictul poate ajunge \u00een instan\u021b\u0103 \u0219i se poate solda cu plata unor daune. Dac\u0103 te reg\u0103se\u0219ti \u00eentr-o astfel de situa\u021bie, cel mai indicat este s\u0103 consul\u021bi un jurist sau un avocat.<\/p>\n\n\n\n<p>Prin urmare, exist\u0103 mai multe modalit\u0103\u021bi prin care po\u021bi \u00eenceta un contract de \u00eenchiriere, indiferent c\u0103 e\u0219ti chiria\u0219 sau proprietar.
