Se impune \u00eens\u0103 o precizare: toate prevederile de mai jos pot fi garantate doar prin semnarea unui contract de \u00eenchiriere (loca\u021biune); lipsa unui astfel de acord \u00eentre proprietar (locator) \u0219i chiria\u0219 (locatar) poate duce la abuzuri &#8211; de ambele p\u0103r\u021bi.<\/p>\n<p><a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2013\/07\/mutatincasanoua.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-26074\" src=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2013\/07\/mutatincasanoua-300x200.jpg\" alt=\"mutatincasanoua\" width=\"300\" height=\"200\" srcset=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2013\/07\/mutatincasanoua-300x200.jpg 300w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2013\/07\/mutatincasanoua-87x57.jpg 87w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2013\/07\/mutatincasanoua-65x43.jpg 65w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2013\/07\/mutatincasanoua-154x103.jpg 154w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2013\/07\/mutatincasanoua.jpg 480w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Drepturile_tale\"><\/span>Drepturile tale:<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>1. Ai dreptul s\u0103 prime\u0219ti locuin\u021ba, \u00eempreun\u0103 cu toate accesoriile sale, \u00eentr-o stare corespunz\u0103toare utiliz\u0103rii acesteia.<br \/>\n2. Ai dreptul la \u201elini\u0219tita \u0219i utila folosin\u021b\u0103\u201d a bunului pe tot parcursul loca\u021biunii (\u00eenchirierii); proprietarul este obligat s\u0103 fac\u0103 tot ceea ce este necesar pentru a-\u021bi asigura acest privilegiu \u00een mod constant, fiind dator s\u0103 se ab\u0163in\u0103 de la orice ar putea \u00eempiedica, diminua sau st\u00e2njeni o asemenea folosin\u0163\u0103 (cum ar fi vizitele neanun\u021bate, \u00een prezen\u021ba sau absen\u021ba proprietarului).<br \/>\n3. Locatorul este obligat s\u0103 efectueze toate repara\u0163iile necesare pentru men\u0163inerea bunului \u00een stare corespunz\u0103toare de \u00eentrebuin\u0163are pe toat\u0103 durata \u00eenchirierii, conform destina\u0163iei stabilite.<br \/>\n4. Proprietarul garanteaz\u0103 contra tuturor viciilor imobilului care \u00eempiedic\u0103 sau diminueaz\u0103 utilitatea lui, chiar dac\u0103 nu le-a cunoscut la \u00eencheierea contractului. Acesta poate fi obligat la desp\u0103gubiri pentru prejudiciile cauzate asupra vie\u0163ii, s\u0103n\u0103t\u0103\u0163ii sau integrit\u0103\u0163ii tale corporale. Dac\u0103 viciile nu sunt \u00eenl\u0103turate \u00een cel mai scurt termen, ai dreptul la o sc\u0103dere propor\u0163ional\u0103 a chiriei. \u00cen cazul \u00een care defec\u021biunile sunt at\u00e2t de grave \u00eenc\u00e2t, dac\u0103 le-ai fi cunoscut, nu ai fi luat bunul \u00een chirie, po\u021bi rezilia contractul, \u00een condi\u0163iile legii.<br \/>\n5. \u00cen cl\u0103dirile cu mai multe apartamente, ai dreptul de a \u00eentrebuin\u0163a p\u0103r\u0163ile \u015fi instala\u0163iile de folosin\u0163\u0103 comun\u0103 potrivit cu destina\u0163ia fiec\u0103reia, la fel ca ceilal\u021bi locatari.<br \/>\n6. Ai dreptul s\u0103 fii anun\u021bat din timp cu privire la p\u0103r\u0103sirea locuin\u021bei. Pentru contractele pe perioad\u0103 determinat\u0103 \u0219i nedeterminat\u0103 (\u00een care nu se stipuleaz\u0103 altfel), proprietarul poate denun\u0163a acordul de \u00eenchiriere prin notificare, cu respectarea unui preaviz ce nu poate fi mai mic de 60 de zile (dac\u0103 intervalul de timp pentru care s-a stabilit plata chiriei este de o lun\u0103 sau mai mare) sau 15 zile (pentru un interval mai mic de o lun\u0103).<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Obligatiile_tale\"><\/span>Obliga\u021biile tale:<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>1. Trebuie s\u0103 pl\u0103te\u0219ti chiria \u00een cuantumul \u015fi la termenul stabilite prin contract.<br \/>\n2. Cheltuielile adiacente generate de utilizarea locuin\u021bei (precum \u00eentre\u021binere, lumin\u0103, cablu, internet etc.) sunt responsabilitatea ta, cu excep\u021bia cazului \u00een care \u00een contract se stipuleaz\u0103 altfel.<br \/>\n3. Ai obliga\u021bia de a folosi bunul cu pruden\u0163\u0103 \u015fi diligen\u0163\u0103, potrivit destina\u0163iei stabilite prin contract; dac\u0103 aduci modific\u0103ri imobilului, \u00eei schimbi destina\u0163ia sau dac\u0103 \u00eel folose\u0219ti astfel \u00eenc\u00e2t \u00eel prejudiciezi pe proprietar, acesta poate cere daune-interese \u015fi, dup\u0103 caz, rezilierea contractului.<br \/>\n4. Cad \u00een sarcina ta acele repara\u0163ii locative a c\u0103ror necesitate rezult\u0103 din folosin\u0163a obi\u015fnuit\u0103 a bunului.<br \/>\n5. E\u0219ti obligat, sub sanc\u0163iunea pl\u0103\u0163ii de daune-interese \u015fi a suport\u0103rii oric\u0103ror alte cheltuieli, s\u0103 notifici de \u00eendat\u0103 proprietarul cu privire la necesitatea acelor repara\u0163ii care sunt \u00een sarcina acestuia.<br \/>\n6. Trebuie s\u0103 permi\u021bi examinarea periodic\u0103 a locuin\u021bei de c\u0103tre locator (la intervale rezonabile), precum \u015fi de c\u0103tre aceia care doresc s-o cumpere sau s-o \u00eenchirieze pe viitor, f\u0103r\u0103 ca acest fapt s\u0103 \u00eempiedice folosin\u021ba sa obi\u0219nuit\u0103.<br \/>\n7. Pentru contractele pe perioad\u0103 nedeterminat\u0103 (\u00een care nu s-a convenit altfel), po\u021bi denun\u0163a unilateral contractul prin notificare, cu respectarea unui termen de preaviz ce nu poate fi mai mic dec\u00e2t sfertul intervalului de timp pentru care s-a stabilit plata chiriei. Pentru acordurile pe perioad\u0103 determinat\u0103, trebuie s\u0103 respec\u021bi un termen de preaviz de cel pu\u0163in 60 de zile. (Orice clauz\u0103 contrar\u0103 este considerat\u0103 nescris\u0103.)<br \/>\n8.
