Doar un contract legal te poate proteja \u00een cazul \u00eenc\u0103lc\u0103rii drepturilor tale:<\/strong><br \/>\n\u00cen calitate de chiria\u0219, ai at\u00e2t drepturi, c\u00e2t \u0219i obliga\u021bii, potrivit Noului Cod Civil al Rom\u00e2niei. Respectarea acestora poate fi garantat\u0103 \u00eens\u0103 doar prin \u00eencheierea unui contract legal. \u00cen lipsa unui astfel de act, po\u021bi deveni cu u\u0219urin\u021b\u0103 \u021binta unor abuzuri din partea proprietarului: acesta poate neglija realizarea repara\u021biilor necesare \u00een locuin\u021b\u0103, \u00ee\u021bi poate refuza restituirea garan\u021biei sau chiar te poate da afar\u0103 din cas\u0103 pe nepus\u0103 mas\u0103. <\/p>\n<p><strong>2. Atunci c\u00e2nd te mu\u021bi \u00eentr-o locuin\u021b\u0103, aceasta trebuie s\u0103 fie \u00eentr-o stare bun\u0103 de func\u021bionare:<\/strong><br \/>\nPotrivit legii, proprietarul are obliga\u021bia de a-\u021bi preda locuin\u021ba \u00eenchiriat\u0103, \u00eempreun\u0103 cu toate accesoriile sale, \u00eentr-o stare corespunz\u0103toare utiliz\u0103rii acesteia. De asemenea, acesta trebuie s\u0103 men\u021bin\u0103 imobilul \u00eentr-o astfel de stare pe tot parcursul utiliz\u0103rii sale (chiria\u0219ul este obligat s\u0103 notifice proprietarul cu privire la necesitatea efectu\u0103rii repara\u021biilor necesare pentru aceasta). Cu toate acestea, repara\u021biile care rezult\u0103 din folosin\u021ba obi\u0219nuit\u0103 a bunului cad \u00een responsabilitatea ta. <\/p>\n<p><strong>3. Proprietarul nu are dreptul s\u0103 vin\u0103 neanun\u021bat:<\/strong><br \/>\nCa \u0219i chiria\u0219, ai dreptul la \u201elini\u0219tita \u0219i utila folosin\u021b\u0103\u201d a imobilului pe tot parcursul loca\u021biunii (\u00eenchirierii), iar proprietarul este obligat s\u0103 se ab\u0163in\u0103 de la orice ar putea \u00eempiedica, diminua sau st\u00e2njeni o asemenea folosin\u0163\u0103 (cum ar fi vizitele neanun\u021bate, \u00een prezen\u021ba sau absen\u021ba chiria\u0219ului). Cu toate acestea, tu trebuie s\u0103 permi\u021bi examinarea periodic\u0103 a locuin\u021bei at\u00e2t de c\u0103tre locator (la intervale rezonabile), c\u00e2t \u015fi de c\u0103tre aceia care doresc s-o cumpere sau s-o \u00eenchirieze pe viitor.<\/p>\n<p><strong>4. Pe toat\u0103 perioada \u00eenchirierii, r\u0103spunzi de starea locuin\u021bei:<\/strong><br \/>\n\u00cen intervalul stabilit de acordul de \u00eenchiriere, ai obliga\u021bia de a folosi bunul imobil cu pruden\u0163\u0103. La \u00eencetarea contractului, trebuie s\u0103 predai locuin\u021ba \u00een starea \u00een care ai primit-o (\u00een afar\u0103 de ceea ce a pierit sau s-a deteriorat din cauza vechimii). Legea prevede c\u0103 locatarul r\u0103spunde pentru degradarea bunului \u00eenchiriat \u00een timpul folosin\u0163ei sale, inclusiv pentru cea cauzat\u0103 de incendiu (except\u00e2nd cazul \u00een care dovede\u015fte c\u0103 acesta a survenit fortuit). Chiria\u0219ul este r\u0103spunz\u0103tor totodat\u0103 pentru daunele cauzate de membrii familiei sale, de sublocatarul s\u0103u, ca \u015fi de alte persoane c\u0103rora le-a \u00eeng\u0103duit folosirea sau accesul la imobil.<\/p>\n<p><strong>5. Nu po\u021bi fi dat afar\u0103 de pe o zi pe alta:<\/strong><br \/>\nAt\u00e2t chiria\u0219ul, c\u00e2t \u0219i proprietarul au dreptul de a rezilia \u00een mod unilateral contractul, prin notificarea prealabil\u0103 a celeilalte p\u0103r\u021bi. Pentru contractele pe perioad\u0103 determinat\u0103 \u0219i nedeterminat\u0103 (\u00een care nu se stipuleaz\u0103 altfel), proprietarul trebuie s\u0103 respecte un preaviz ce nu poate fi mai mic de 60 de zile (dac\u0103 intervalul de timp pentru care s-a stabilit plata chiriei este de o lun\u0103 sau mai mare) sau 15 zile (pentru un interval mai mic de o lun\u0103).<\/p>\n<p>\u00cen calitate de locatar, tu po\u021bi rezilia acordul cu proprietarul prin respectarea unui termen de preaviz ce nu poate fi mai mic dec\u00e2t sfertul intervalului de timp pentru care s-a stabilit plata chiriei (pentru contractele pe perioad\u0103 nedeterminat\u0103 \u00een care nu s-a convenit altfel). Pentru acordurile pe perioad\u0103 determinat\u0103, trebuie s\u0103 respec\u021bi un termen de preaviz de cel pu\u0163in 60 de zile.
