Obiectul dreptului de proprietate comun\u0103 poate fi alc\u0103tuit at\u00e2t din bunuri mobile c\u00e2t \u015fi din bunuri imobile.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>\u00cen cadrul acestei forme de proprietate, un bun sau o universalitate de bunuri apar\u0163ine mai multor titulari f\u0103r\u0103 ca bunul s\u0103 fie frac\u0163ionat, individualizat. Dreptul de proprietate se frac\u0163ioneaz\u0103 \u00een at\u00e2tea p\u0103r\u0163i, egale sau diferite c\u00e2\u0163i proprietari sunt. Titularii dreptului de proprietate comun\u0103 cunosc doar \u00eentinderea dreptului asupra bunului comun, dar nu cunosc partea material\u0103 din bun care le revine.<\/p>\n<p>Proprietatea comuna obi\u015fnuit\u0103 are o existen\u0163\u0103 limitat\u0103 \u00een timp, adic\u0103 are caracter temporar, deoarece oricare dintre proprietari poate cere ie\u015firea din coproprietate prin partaj. Dreptul de a cere ie\u015firea din aceast\u0103 stare este imprescriptibil (nu \u00eenceteaz\u0103 prin nefolosirea lui \u00eentr-un anumit termen).<\/p>\n<p>\u00cen ceea ce prive\u015fte cota \u2013 parte ideal\u0103 din dreptul de proprietate asupra bunului comun, fiecare titular are un drept propriu exclusiv \u015fi va putea s\u0103 o \u00eenstr\u0103ineze, total sau par\u0163ial, prin acte cu titlu oneros sau gratuit. \u00cen privin\u0163a bunului \u00een materialitatea sa, asupra acestuia nu se pot face acte materiale f\u0103r\u0103 acordul unanim al coproprietarilor.<\/p>\n<p>\u00censtr\u0103inarea bunului comun este valabil\u0103, \u00een situa\u0163ia \u00een care cump\u0103r\u0103torul dob\u00e2nde\u015fte un drept de proprietate sub condi\u0163ie \u015fi cunoa\u015fte calitatea de coproprietar a v\u00e2nz\u0103torului. Dreptul va depinde de rezultatul partajului, \u015fi anume dac\u0103 bunul v\u00e2ndut va c\u0103dea \u00een lotul coproprietarului v\u00e2nz\u0103tor. Dac\u0103 bunul cade \u00een alt lot, v\u00e2nzarea se consider\u0103 c\u0103 nu ar fi existat.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Obligatiile_coproprietarilor\"><\/span>Obliga\u021biile coproprietarilor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Coproprietarii au o serie de obliga\u0163ii cu privire la \u00eentre\u0163inerea, conservarea \u015fi administrarea bunului. Cheltuielile reale sunt cele necesare sau utile cu privire la bun. De aceste obliga\u0163ii, coproprietarul se poate libera prin renun\u0163area la drept, \u00eens\u0103 acesta renun\u0163are va avea efect doar pentru viitor. Cheltuielile datorate p\u00e2n\u0103 la acea dat\u0103 r\u0103m\u00e2n \u00een sarcina coproprietarului. Prin excep\u0163ie, coproprietarii pot \u00eencheia o conven\u0163ie de men\u0163inere a st\u0103rii de proprietate pe o durat\u0103 de cel mult cinci ani, cu posibilitatea ca, la expirarea acestui termen, conven\u0163ia s\u0103 fie re\u00eennoit\u0103.<\/p>\n<p>Un coproprietar nu poate construi f\u0103r\u0103 consim\u0163\u0103m\u00e2ntul tuturor coindivizarilor. \u00cen ceea ce prive\u015fte ac\u0163iunea \u00een evacuarea chiria\u015fului care folose\u015fte un imobil indiviz, dac\u0103 cererea se \u00eentemeiaz\u0103 pe faptul cauz\u0103rii unor prejudicii \u00eensemnate locuin\u0163ei, aceasta poate fi introdus\u0103 numai de c\u0103tre unul din coproprietari deoarece are caracterul unui act de conservare.
