Spre deosebire de celelalte dezmembr\u0103minte, servitutea reprezint\u0103 o simpl\u0103 limitare a dreptului de proprietate, o \u00eengr\u0103dire \u00een exercitarea dreptului s\u0103u.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Dup\u0103 modul de exercitare, servitu\u0163ile se \u00eempart \u00een continue \u015fi necontinue. Servitutea continu\u0103 este cea care se exercit\u0103 f\u0103r\u0103 ca omul s\u0103 fie obligat s\u0103 fac\u0103 acte succesive \u015fi repetate de uz, pe c\u00e2nd cea necontinu\u0103 necesit\u0103 neap\u0103rat interven\u0163ia titularului servitu\u0163ii. Spre exemplu servitutea de scurgere a apei de ploaie este o servitute continu\u0103 deoarece nu presupune acte de uz pozitiv din partea proprietarului dominant. Codul civil enumer\u0103 \u015fi alte asemenea servitu\u0163i: de vedere, de apeduct, de a nu cl\u0103di peste o anumit\u0103 \u00een\u0103l\u0163ime. Servitu\u0163ile necontinue necesit\u0103 acte pozitive de folosin\u0163\u0103, cum sunt servitutea de trecere, de a lua ap\u0103 de la f\u00e2nt\u00e2n\u0103, de a p\u0103\u015funa vitele \u015fi altele.<\/p>\n<p>Servitu\u0163ile stabilite de lege au \u00een vedere fie utilitatea public\u0103, fie utilitatea proprietarilor. Servitu\u0163ile de interes privat sunt obliga\u0163ii reciproce impuse proprietarilor fondurilor \u00eenvecinate, pentru evitarea eventualelor litigii.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Prevederile_Codului_Civil\"><\/span>Prevederile Codului Civil<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Potrivit art. 607 Cod civil, arborii care cresc \u00eenal\u0163i nu pot fi planta\u0163i dec\u00e2t la o distan\u0163\u0103 de minimum 2 m de linia desp\u0103r\u0163itoare a celor doua propriet\u0103\u0163i, iar celelalte planta\u0163ii ori garduri vii, la o distan\u0163\u0103 mai mic\u0103 de jum\u0103tate de metru, dac\u0103 nu exist\u0103 alte reglement\u0103ri. C\u00e2nd aceste obliga\u0163ii nu sunt respectate, proprietarul are dreptul la o ac\u0163iune \u00een justi\u0163ie \u00eempotriva vecinului s\u0103u pentru scoaterea arborilor sau obligarea acestuia la t\u0103ierea crengilor ce dep\u0103\u015fesc proprietatea sa. Pentru promovarea acestei ac\u0163iuni \u00een justi\u0163ie, proprietarul nu trebuie s\u0103 dovedeasc\u0103 faptul c\u0103 ar fi suferit vreun prejudiciu.  Dreptul de a avea o planta\u0163ie la o distan\u0163\u0103 inferioar\u0103 se poate dob\u00e2ndi \u015fi prin uzucapiune, av\u00e2nd \u00een vedere c\u0103 aceasta este o servitute continu\u0103 \u015fi aparent\u0103.<\/p>\n<p>Servitutea de trecere reprezint\u0103 acel drept al proprietarului de teren al c\u0103rui loc este \u00eenfundat, care nu are nicio ie\u015fire la calea public\u0103, prin care proprietarul poate reclama o trecere pe terenul vecinului s\u0103u pentru exploatarea fondului, cu obliga\u0163ia de a-l desp\u0103gubi, \u00een propor\u0163ie cu paguba care s-ar ocaziona. Trecerea trebuie f\u0103cut\u0103 pe calea cea mai scurt\u0103 pentru a ajunge la calea public\u0103, titularul acestei servitu\u0163i fiind obligat s\u0103 aleag\u0103 trecerea care ar pricinui cea mai mica pagub\u0103.
