S\u0103pt\u0103m\u00e2na trecut\u0103 pre\u0219edintele Klaus Iohannis a anun\u021bat promulgarea actului legislativ, textul acestuia fiind publicat \u00een aceea\u0219i zi \u00een Monitorul Oficial. \u201eAceast\u0103 lege a ajuns ini\u0163ial la mine \u015fi am retrimis-o \u00een Parlament cu c\u00e2teva observa\u0163ii. La momentul respectiv, dup\u0103 p\u0103rerea mea, legea nu a fost foarte bine elaborat\u0103. Parlamentul a luat \u00een considerare aceste observa\u0163ii pe care le-am trimis, a modificat legea corespunz\u0103tor \u015fi mi-a retrimis legea \u00een forma nou\u0103. Am apreciat faptul c\u0103 Parlamentul a \u0163inut cont de observa\u0163iile mele \u015fi consider c\u0103 legea \u00een forma \u00een care a ajuns acum la promulgare este \u00een regul\u0103\u201d, noteaz\u0103 pre\u0219edintele \u021b\u0103rii. Actul legislativ va intra \u00een vigoare la 15 zile de la data public\u0103rii \u00een Monitorul Oficial (28 aprilie 2016).<\/p>\n<p><a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2016\/05\/house-keys.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2016\/05\/house-keys.jpg\" alt=\"http:\/\/www.dreamstime.com\/stock-photo-handing-over-house-keys-inside-empty-room-image29098630\" width=\"600\" height=\"399\" class=\"aligncenter size-full wp-image-37744\" srcset=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2016\/05\/house-keys.jpg 600w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2016\/05\/house-keys-300x200.jpg 300w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2016\/05\/house-keys-87x57.jpg 87w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2016\/05\/house-keys-65x43.jpg 65w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2016\/05\/house-keys-154x103.jpg 154w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p><strong>Creditele prin Prima Cas\u0103, excep\u021bia de la regul\u0103<\/strong><br \/>\nUna dintre principalele obiec\u021bii aduse de c\u0103tre mediul bancar acestei ini\u021biative \u021bine de aplicabilitatea sa retroactiv\u0103. Aceast\u0103 prevedere a fost p\u0103strat\u0103 \u00eens\u0103 de c\u0103tre parlamentari, dup\u0103 cum se arat\u0103 \u00een textul oficial: \u201e\u00cen vederea echilibr\u0103rii riscurilor izvor\u00e2nd din contractul de credit, precum \u0219i din devalorizarea bunurilor imobile, prezenta lege se aplic\u0103 at\u00e2t contractelor de credit aflate \u00een derulare la momentul intr\u0103rii sale \u00een vigoare, c\u00e2t \u0219i contractelor \u00eencheiate dup\u0103 aceast\u0103 dat\u0103.\u201d <\/p>\n<p>Forul legislativ a f\u0103cut \u00eens\u0103 \u0219i dou\u0103 concesii importante mediului bancar, ce ar trebui s\u0103 u\u0219ureze, cel pu\u021bin teoretic, presiunea previzionat\u0103 asupra pie\u021bei credit\u0103rii. Cea dint\u00e2i este c\u0103 legea nu se va aplica creditelor acordate prin programul Prima Cas\u0103. Acest fapt ar \u00eensemna c\u0103 programul guvernamental ar trebui s\u0103 mearg\u0103 mai departe (cu condi\u021bia supliment\u0103rii fondurilor de c\u0103tre stat, desigur). <\/p>\n<p>Cea de-a doua concesie const\u0103 \u00een stabilirea unui plafon maxim pentru creditele ce vor putea face obiectul d\u0103rii \u00een plat\u0103 \u2013 chiar dac\u0103 acesta este ceva mai mare dec\u00e2t cel vehiculat ini\u021bial, respectiv 150.000 de euro. Astfel, cuantumul sumei \u00eemprumutate, la momentul acord\u0103rii, nu trebuie s\u0103 dep\u0103\u0219easc\u0103 echivalentul \u00een lei a 250.000 euro (sum\u0103 calculat\u0103 la cursul de schimb publicat de c\u0103tre Banca Na\u021bional\u0103 a Rom\u00e2niei \u00een ziua \u00eencheierii contractului de credit).<\/p>\n<blockquote><p><strong>Legea d\u0103rii \u00een plat\u0103 a unor bunuri imobile \u00een vederea stingerii obliga\u021biilor asumate prin credite<\/strong><\/p>\n<p><em>\u201ePrin derogare de la dispozi\u021biile Legii nr. 287\/2009 privind Codul Civil, republicat\u0103, cu modific\u0103rile ulterioare, consumatorul are dreptul de a i se stinge datoriile izvor\u00e2te din contractele de credit cu tot cu accesorii, f\u0103r\u0103 costuri suplimentare, prin darea \u00een plat\u0103 a imobilului ipotecat \u00een favoarea creditorului, dac\u0103 \u00een termenul prev\u0103zut la art. 5 (alin. 3) [30 de zile, n.red.] p\u0103r\u021bile contractului de credit nu ajung la un alt acord.\u201d <strong>(art. 3)<\/strong><\/p>\n<p>\u201eCreditul a fost contractat de c\u0103tre consumator cu scopul de a achizi\u021biona, construi, extinde, moderniza, amenaja, reabilita un imobil cu destina\u021bie de locuin\u021b\u0103 sau, indiferent de scopul pentru care a fost contractat, este garantat cu cel pu\u021bin un imobil av\u00e2nd destina\u021bia de locuin\u021b\u0103.\u201d <strong>(art. 4, alin. 1, pct. c)<\/strong><\/p>\n<p>\u201e\u00cen situa\u021bia \u00een care executarea obliga\u021biilor asumate prin contractul de credit a fost garantat\u0103 cu dou\u0103 sau mai multe bunuri, \u00een vederea aplic\u0103rii procedurii prev\u0103zute de prezenta lege debitorul va oferi \u00een plat\u0103 toate bunurile ipotecate \u00een favoarea creditorului.\u201d <strong>(art. 4, alin. 2)<\/strong><\/p>\n<p>\u201eDreptul de a cere instan\u021bei s\u0103 constate stingerea datoriilor izvor\u00e2te din contractele de credit apar\u021bine \u0219i consumatorului care a fost supus unei execut\u0103ri silite a imobilului ipotecat, indiferent de titularul crean\u021bei, de stadiul \u00een care se afl\u0103 ori de forma execut\u0103rii silite care se continu\u0103 \u00eempotriva debitorului.\u201d <strong>(art. 8, alin. 5)<\/strong><\/p>\n<p>Legea \u201esuspend\u0103 dreptul creditorului de a se \u00eendrepta \u00eempotriva codebitorilor, precum \u0219i \u00eempotriva garan\u021bilor personali sau ipotecari.\u201d <strong>(art. 6, alin. 1)<\/strong><\/p>\n<p>\u201eDemersurile (&#8230;) pot fi \u00eentreprinse \u0219i de c\u0103tre codebitori, precum \u0219i de garan\u021bii personali sau ipotecari ai consumatorului principal, cu acordul acestuia sau al succesorilor s\u0103i.\u201d <strong>(art. 6, alin. 3)<\/strong><\/em><\/p>\n<p><em><strong>Sursa: Monitorul Oficial, nr. 330, 28 aprilie 2016<\/strong><\/em><\/p><\/blockquote>\n<p><strong>Banca are dreptul s\u0103 conteste preten\u021bia debitorului<\/strong><br \/>\nTextul legii detaliaz\u0103 \u0219i procedura de dare \u00een plat\u0103 a unui imobil. Mai \u00eent\u00e2i, consumatorul trebuie s\u0103 transmit\u0103 creditorului, prin intermediul unui notar, avocat sau executor judec\u0103toresc, \u00een\u0219tiin\u021barea c\u0103 a decis s\u0103 \u00eei transmit\u0103 dreptul de proprietate al bunului \u00een vederea stingerii datoriei. \u00cen notificare  se va preciza un interval orar, \u00een dou\u0103 zile diferite, \u00een care reprezentantul institu\u021biei de credit va trebui s\u0103 se prezinte la un notar public propus de debitor pentru \u00eencheierea actului translativ de proprietate (primul termen nu poate fi mai mic de 30 de zile). De la data primirii acestei notific\u0103ri, orice plat\u0103 c\u0103tre creditor se suspend\u0103, la fel ca \u0219i orice ac\u021biune procedur\u0103 judiciar\u0103 sau extrajudiciar\u0103 demarat\u0103 asupra consumatorului \u0219i bunurilor sale.<\/p>\n<p>\u00cen termen de 10 zile de la data primirii notific\u0103rii, creditorul poate contesta \u00eendeplinirea condi\u021biilor de admisibilitate a procedurii de dare \u00een plat\u0103. Cererea se va judeca \u00een regim de urgen\u021b\u0103, cu citarea p\u0103r\u021bilor, de judec\u0103toria \u00een circumscrip\u021bia c\u0103reia domiciliaz\u0103 consumatorul. \u00cen situa\u021bia \u00een care contesta\u021bia se admite, cele dou\u0103 p\u0103r\u021bi vor fi repuse \u00een situa\u021bia anterioar\u0103 \u00eendeplinirii demersurilor prev\u0103zute de lege.<\/p>\n<p>La momentul \u00eencheierii actului translativ de proprietate, respectiv de la data pronun\u021b\u0103rii hot\u0103r\u00e2rii judec\u0103tore\u0219ti definitive, va fi stins\u0103 orice datorie a debitorului fa\u021b\u0103 de creditor, acesta din urm\u0103 neput\u00e2nd solicita sume de bani suplimentare.
