Aceast\u0103 norm\u0103 intr\u0103 \u00een vigoare la 1 ianuarie 2010, \u00een urma modific\u0103rii articolului 127 din Codul Fiscal. Se consider\u0103 astfel c\u0103 orice persoan\u0103 fizic\u0103 care deruleaz\u0103 mai mult de o tranzac\u021bie imobiliar\u0103 \u00een cursul unui an calendaristic desf\u0103\u0219oar\u0103 o activitate economic\u0103 cu caracter de continuitate \u0219i este obligat\u0103 a\u0219adar s\u0103 pl\u0103teasc\u0103 TVA. De la aceast\u0103 prevedere sunt excluse imobilele folosite de c\u0103tre proprietar \u00een scopuri personale.<\/p>\n<p><strong>&#8230;mai \u00eenainte a existat practica<\/strong><br \/>\nCu doi ani \u00eenainte de intrarea \u00een vigoare a acestei legi, de la 1 ianuarie 2008, Agen\u021bia Na\u021bional\u0103 de Administrare Fiscal\u0103 (ANAF) a cerut \u00eens\u0103 plata TVA pentru astfel de tranzac\u021bii, potrivit lui Garbi\u0219 Vincen\u021biu Kehaiyan, pre\u0219edintele Asocia\u021biei de Prevenire a Abuzurilor Fiscale (APAF). \u201cLumea a \u00eenceput s\u0103 pl\u0103teasc\u0103 TVA din bun-sim\u021b pentru stat, de\u0219i nu exista o lege \u00een acest sens\u201d, subliniaz\u0103 acesta. Lucrurile au mers \u00eens\u0103 prea departe \u00een momentul \u00een care, la sf\u00e2r\u0219itul anului 2009, ANAF a cerut plata retroactiv\u0103 a TVA de c\u0103tre persoanele fizice care au derulat tranzac\u021bii imobiliare cu caracter de continuitate din 2002 \u00eencoace. P\u00e2n\u0103 la data redact\u0103rii acestui articol, reprezentan\u021bii ANAF nu au dat un r\u0103spuns cu privire la legea \u00een baza c\u0103reia a fost formulat\u0103 o astfel de cerere. Potrivit lui Kehaiyan, ANAF a motivat c\u0103 o prevedere \u00een acest sens exista \u0219i \u00een urm\u0103 cu opt ani, chiar sub forma articolului 127, alineatul 2 din Codul Fiscal valabil la acea vreme. Acesta define\u0219te activit\u0103\u021bile economice impozabile: \u201cactivit\u0103\u021bile produc\u0103torilor, comercian\u021bilor sau prestatorilor de servicii, inclusiv activit\u0103\u021bile extractive, agricole \u0219i activit\u0103\u021bile profesiilor libere sau asimilate acestora. De asemenea, constituie activitate economic\u0103 exploatarea bunurilor corporale sau necorporale, \u00een scopul ob\u021binerii de venituri cu caracter de continuitate\u201d.<\/p>\n<p><strong>73.000 de v\u00e2nz\u0103tori, urm\u0103toarea \u021bint\u0103<\/strong><br \/>\nProtestele v\u00e2nz\u0103torilor \u2013 dezvoltatori sau nu &#8211; viza\u021bi de respectiva prevedere nu s-au l\u0103sat a\u0219teptate. Ace\u0219tia au \u00eenfiin\u021bat rapid Asocia\u021bia de Prevenire a Abuzurilor Fiscale (APAF). \u201cNici m\u0103car o persoan\u0103 nu a \u00een\u021beles legea a\u0219a cum a \u00een\u021beles-o ANAF\u201d, motiveaz\u0103 Kehaiyan. \u00cen momentul de fa\u021b\u0103, sunt 7.145 de dezvoltatori care au v\u00e2ndut peste cinci imobile \u0219i ar intra astfel \u00een sfera de ac\u021biune a ANAF, precizeaz\u0103 reprezentantul APAF. Pe l\u00e2ng\u0103 ace\u0219tia \u00eens\u0103, exist\u0103 al\u021bi 73.000 de oameni care au v\u00e2ndut dou\u0103-trei apartamente \u0219i care ar constitui urm\u0103toarea \u021bint\u0103. \u201cDatoria de recuperat de la dezvoltatori este de 14 miliarde de RON, \u00een vreme ce datoria de la v\u00e2nz\u0103torii mai mici se ridic\u0103 la 70 de miliarde de RON\u201d, subliniaz\u0103 Kehaiyan. \u00cen prezent, se afl\u0103 \u00een control 1.850 de dosare. \u00cen decurs de \u0219ase luni, au fost finalizate 250 de dosare.<\/p>\n<p><strong>Toate tipurile de imobile, sub inciden\u021ba legii<\/strong><br \/>\nLucrurile nu par s\u0103 se opreasc\u0103 aici. Pre\u0219edintele APAF sus\u021bine c\u0103 legea, a\u0219a cum o interpreteaz\u0103 ANAF, nu poate fi aplicat\u0103 doar la imobile noi, ci trebuie extins\u0103, \u00een mod automat, la orice fel de tranzac\u021bii imobiliare care au caracter de continuitate. Cu alte cuvinte, \u0219i o persoan\u0103 care a v\u00e2ndut dou\u0103 sau mai multe terenuri sau apartamente vechi poate fi pus\u0103 \u00een situa\u021bia de a pl\u0103ti retroactiv TVA la stat. \u201cVor lua pe toat\u0103 lumea. Vor fi foarte mul\u021bi oameni care nu vor mai avea nici propriet\u0103\u021bi, nici apartamente. Mihai Florescu, reprezentantul oficial al acestei organiza\u021bii, spune c\u0103, din punct de vedere legal, ANAF are obliga\u021bia de a recupera banii de la cump\u0103r\u0103tor \u00een cazul \u00een care v\u00e2nz\u0103torul nu poate pl\u0103ti. Potrivit articolului 51 din Codul Fiscal, \u00een caz de neplat\u0103, cump\u0103r\u0103torul este solidar cu v\u00e2nz\u0103torul. \u201cTo\u021bi cump\u0103r\u0103torii de imobile noi pot fi chema\u021bi s\u0103 pl\u0103teasc\u0103 19% peste pre\u021bul pe care l-au pl\u0103tit deja. La aceasta se adaug\u0103 \u0219i penalit\u0103\u021bi de 36% pe an\u201d, subliniaz\u0103 Florescu. Acesta precizeaz\u0103 c\u0103, potrivit informa\u021biilor sale, \u00een categoria vizat\u0103 de ANAF se \u00eencadreaz\u0103 circa un milion de tranzac\u021bii.<\/p>\n<p><strong>Bulg\u0103re de z\u0103pad\u0103 social \u0219i economic<\/strong><br \/>\nCare ar fi consecin\u021bele extinderii la scar\u0103 larg\u0103 a pl\u0103\u021bii retroactive a TVA? La nivel social, nu este greu de ghicit. \u201cE o modificare grav\u0103 a costului apartamentului. La un pre\u021b de 100.000 de euro, se poate ajunge \u0219i la 40.000 de euro, incluz\u00e2nd penalit\u0103\u021bile\u201d, spune Florescu. Mul\u021bi se vor afla, \u00een actualul context economic, \u00een imposibilitate de plat\u0103. \u201cCele mai multe persoane care au cump\u0103rat au un credit. \u00cen momentul \u00een care ANAF nu va recupera banii de v\u00e2nz\u0103tor, va merge la cump\u0103r\u0103tor. Dac\u0103 acesta nu va putea pl\u0103ti, va fi executat silit\u201d, spune avocatul Ionu\u021b Mateescu.<br \/>\nCe ar \u00eensemna \u00eens\u0103 ca 100.000 de locuin\u021be s\u0103 fie v\u00e2ndute sub pre\u021bul pie\u021bei \u00een decurs de \u0219ase luni? Un asemenea fenomen ar duce, \u00een mod inevitabil, la un declin rapid al pre\u021bului de pia\u021b\u0103 al locuin\u021belor. Dincolo de satisfac\u021bia pe care acesast\u0103 sc\u0103dere ar genera-o \u00een r\u00e2ndul poten\u021bialilor cump\u0103r\u0103tori, consecin\u021bele macroeconomice at\u00e2rn\u0103 mai greu \u00een balan\u021b\u0103. Un asemenea fenomen ar afecta \u00een mod direct sistemul bancar, din cauza sc\u0103derii masive a valorii bunurilor folosite ca garan\u021bie pentru credite. Rom\u00e2nii care au contractat \u00eemprumuturi s-ar putea trezi \u00een situa\u021bia ca banca s\u0103 le pun\u0103 sechestru nu doar pe cas\u0103, ci \u0219i pe alte bunuri, pentru a completa astfel valoarea ini\u021bial\u0103 a creditului. \u201cInteresul comun al tuturor b\u0103ncilor este s\u0103 nu scad\u0103 valoarea de pia\u021b\u0103 a bunurilor folosite ca garan\u021bii pentru ele\u201d, spune Mateescu. \u00cen fa\u021ba unei asemenea perspective, reac\u021bia v\u00e2nz\u0103torilor \u0219i cump\u0103r\u0103torilor deopotriv\u0103 nu se las\u0103 a\u0219teptat\u0103. \u201cVor fi sute de mii de procese\u201d, anticipeaz\u0103 Florescu.
