Odat\u0103 cu aceast\u0103 cerere, executorul judec\u0103toresc se va deplasa la locul unde este situat imobilul urm\u0103rit \u00een vederea identific\u0103rii acestuia, \u00eencheind un proces &#8211; verbal de situa\u0163ie, cu descrierea am\u0103nun\u0163it\u0103 a imobilului. Ulterior o soma\u0163ie va fi comunicat\u0103 debitorului cu men\u0163iunea c\u0103 s-a luat m\u0103sura \u00eenscrierii \u00een cartea funciar\u0103. Potrivit art 500 alin. (1) C. proc. Civ., dac\u0103 \u00een termen de 15 zile de la data primirii soma\u0163iei debitorul nu pl\u0103te\u015fte datoria, \u00eencepe procedura de v\u00e2nzare. Executorul judec\u0103toresc \u00eempreun\u0103 cu p\u0103r\u0163ile \u2013 solicit\u00e2nd p\u0103rerea unui expert \u2013 vor stabili pre\u0163ul de v\u00e2nzare al imobilului la valoarea de circula\u0163ie. De asemenea executorul va comunica titularilor celorlalte drepturi asupra imobilului \u2013 dac\u0103 ace\u015ftia exist\u0103 \u2013 despre existen\u0163a execut\u0103rii \u015fi \u00eei citeaz\u0103 la termenele fixate pentru v\u00e2nzarea imobilului.<\/p>\n<p>\u00cen termen de 5 zile de la fixarea pre\u0163ului, executorul judec\u0103toresc \u00eentocme\u015fte \u015fi afi\u015feaz\u0103 procesul &#8211; verbal de punere \u00een v\u00e2nzare a imobilului, termenul neput\u00e2nd fi mai scurt de 30 de zile dar nici mai lung de 60 de zile de la afi\u015fare.<br \/>\nParticiparea la licita\u0163ie \u00een vederea cump\u0103r\u0103rii imobilului este condi\u0163ionat\u0103 de depunerea unei cau\u0163iuni la Trezoreria Statului, la C.E.C.  sau la orice institu\u0163ie bancar\u0103, la dispozi\u0163ia executorului judec\u0103toresc p\u00e2n\u0103 la termenul stabilit  pentru v\u00e2nzare, reprezent\u00e2nd 10 % din pre\u0163ul de \u00eencepere a licita\u0163iei pentru termenul respectiv. Dovada consemn\u0103rii va fi ata\u015fat\u0103 ofertei de cump\u0103rare. Num\u0103rul minim de participan\u0163i la o licita\u0163ie nu este expres prev\u0103zut de o norm\u0103 legal\u0103, dar \u00een cazul existen\u0163ei unui singur participant, acesta va avea posibilitatea s\u0103 cumpere imobilul doar la pre\u0163ul de strigare.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Licitatia_propriu-zisa\"><\/span>Licita\u021bia propriu-zis\u0103<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>V\u00e2nzarea se va organiza \u00een loc public, executorul oferind spre v\u00e2nzare imobilul, prin trei anun\u0163uri succesive, pornind de la pre\u0163ul oferit, care este mai mare dec\u00e2t cel la care s-a f\u0103cut evaluarea imobilului, sau \u00een lipsa unei asemenea oferte, chiar la pre\u0163ul stabilit.<\/p>\n<p>Dac\u0103 dup\u0103 aceste anun\u0163uri nu s-a oferit pre\u0163ul la care imobilul a fost evaluat, datorit\u0103 faptul c\u0103 imobilul este grevat de un drept de uz, uzufruct, abita\u0163ie sau servitute \u00eentabulate ulterior \u00eenscrierii vreunei ipoteci, executorul va re\u00eencepe licita\u0163ia liber de aceste drepturi la pre\u0163ul men\u0163ionat \u00een publica\u0163ia de v\u00e2nzare. Dac\u0103 nu se ofer\u0103 nici acest pre\u0163, executorul va am\u00e2na licita\u0163ia pentru un alt termen, care nu poate fi mai t\u00e2rziu de 60 de zile.<\/p>\n<p>La acest termen, licita\u0163ia va \u00eencepe de la 75 % din pre\u0163ul la care imobilul a fost evaluat, iar dac\u0103 nu se ob\u0163ine nici acest pre\u0163, atunci se va vinde la cel mai mare pre\u0163 oferit. Executorul va \u00eentocmi un proces \u2013 verbal despre desf\u0103\u015furarea \u015fi rezultatul fiec\u0103rei licita\u0163ii, men\u0163ion\u00e2nd adjudecatarul imobilului. Acesta trebuie s\u0103 depun\u0103 pre\u0163ul la o unitate bancar\u0103, \u00een termen de cel mult 30 de zile, \u00een caz contrar imobilul se va scoate din nou la licita\u0163ie \u00een contul adjudecatarului. La cererea adjudecatarului, executorul judec\u0103toresc cu acordul creditorului, poate solicita plata \u00een rate a pre\u0163ului. Potrivit art. 513 Cod Procedur\u0103 civil\u0103, acesta va fi obligat s\u0103 pl\u0103teasc\u0103 cheltuielile prilejuite de noua licita\u0163ie \u015fi eventualele diferen\u0163e de pre\u0163. Adjudecatarul va putea s\u0103 achite la termenul de licita\u0163ie pre\u0163ul oferit ini\u0163ial, \u00een acest caz va fi obligat numai la plata cheltuielilor cauzate de noua licita\u0163ie. Dac\u0103 la noul termen de licita\u0163ie imobilul nu a fost v\u00e2ndut fostul adjudecatar este obligat s\u0103 pl\u0103teasc\u0103 toate cheltuielile ocazionate de urm\u0103rirea imobilului.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Adjudecarea\"><\/span>Adjudecarea<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Executorul judec\u0103toresc, pe baza procesului \u2013 verbal de licita\u0163ie, \u00eentocme\u015fte actul de adjudecatare, dup\u0103 expirarea termenului de 15 zile de la data c\u00e2nd s-a a luat cuno\u015ftin\u0163\u0103 de actul de executare \u015fi dup\u0103 plata integral\u0103 a pre\u0163ului de c\u0103tre adjudecatar. Prin actul de adjudecare se transmite dreptul supus la licita\u0163ie de la debitor la adjudecatar. Acest act are valoare de titlu de proprietate \u015fi \u00een baza lui se poate cere \u00eenscrierea \u00een cartea funciar\u0103 a noului proprietar. Imobilul intr\u0103 \u00een proprietatea adjudecatarului liber de orice sarcini sau ipoteci.<\/p>\n<p>Art. 514 Cod procedur\u0103 civil\u0103, dispune ca la cererea celorlal\u0163i participan\u0163i, executorul judec\u0103toresc va dispune restituirea cau\u0163iunilor depuse de ace\u015ftia.<br \/>\nDac\u0103 debitorul refuz\u0103 s\u0103 p\u0103r\u0103seasc\u0103 sau s\u0103 predea imobilul supus licita\u0163iei, respectiv nu \u00ee\u015fi \u00eendepline\u015fte obliga\u0163iile \u00een termen de 5 zile de la primirea soma\u0163iei, acesta va \u00eendep\u0103rtat prin executare silit\u0103, executorul judec\u0103toresc som\u00e2nd pe debitor s\u0103 p\u0103r\u0103seasc\u0103 de \u00eendat\u0103 imobilul, iar \u00een caz de \u00eempotrivire, va elibera imobilul cu ajutorul for\u0163ei publice.<\/p>\n<p>Orice persoan\u0103 interesat\u0103 poate ob\u0163ine informa\u0163ii complete, sau, dup\u0103 caz, aplicate unui caz, concret despre procedura de executare silit\u0103 imobiliar\u0103 de la un avocat, executor judec\u0103toresc sau executor bancar precum \u015fi de la orice persoan\u0103 specialist\u0103 sau cu atribu\u0163ii \u00een domeniul execut\u0103rii silite.
