Pentru o mai mare siguran\u021b\u0103, dup\u0103 semnarea de c\u0103tre p\u0103r\u021bi, este recomandat ca actul s\u0103 fie \u00eenscris \u00een Cartea Funciar\u0103. \u201eLa apartamentele noi, antecontractele sunt foarte stufoase \u015fi sunt destul de greu de urm\u0103rit, mai ales pentru cei care nu au experien\u0163\u0103 \u00een domeniu\u201d, spune Mihaela Grigore, notar. Acesta este \u00eens\u0103 un impediment pe care clientul trebuie s\u0103-l dep\u0103\u0219easc\u0103, chiar dac\u0103 asta \u00eenseamn\u0103 apelarea la un avocat.<\/p>\n<p><strong>Dac\u0103 vrei s\u0103 renun\u021bi la achizi\u021bie<\/strong><br \/>\nO prim\u0103 clauz\u0103 ce trebuie inclus\u0103 neap\u0103rat \u00een antecontract este posibilitatea renun\u021b\u0103rii la achizi\u021bie, cu prevederi exacte legate de ce se va \u00eent\u00e2mpla \u00een astfel de cazuri. De\u0219i poate p\u0103rea inutil\u0103 \u2013 pe baza principiului c\u0103 orice act ar trebui s\u0103 poat\u0103 fi reziliat -, o asemenea clauz\u0103 nu este deloc a\u0219a. Mihaela Grigore ofer\u0103 un exemplu concludent \u00een acest sens: o situa\u021bie \u00een care, dup\u0103 ce a semnat un antecontract pentru achizi\u0163ia unui apartament \u00eentr-un ansamblu \u00een construc\u0163ie, promitentul cump\u0103r\u0103tor a decis s\u0103 nu-l mai cumpere, asum\u00e2ndu-\u0219i pierderea avansului. A realizat \u00eens\u0103 c\u0103 antecontractul nu prevedea o asemenea situa\u0163ie, astfel \u00eenc\u00e2t el era obligat s\u0103 pl\u0103teasc\u0103 apartamentul, chiar dac\u0103 dorea s\u0103 renun\u021be la tranzac\u021bie.<\/p>\n<p><strong>Clauza de penalizare, stabilit\u0103 prin negociere<\/strong><br \/>\nUn alt element indispensabil este clauza de penalizare \u2013 adic\u0103 ce se \u00eent\u00e2mpl\u0103 dac\u0103 dezvoltatorul nu-\u0219i \u00eendepline\u0219te promisiunea de livra locuin\u021ba la termen (sau nu o finalizeaz\u0103 deloc). \u201eSunt multe situa\u0163ii, mai ales acum, c\u0103 a venit criza, \u00een care nu se respect\u0103 termenele de predare &#8211; trebuie prev\u0103zut clar ce se \u00eent\u00e2mpl\u0103 \u00een situa\u0163iile astea, cum se calculeaz\u0103 penalizarea etc. Dac\u0103 dezvoltatorul \u00eent\u00e2rzie foarte mult, cump\u0103r\u0103torul poate avea diverse diverse pagube: poate \u015fi-a v\u00e2ndut o locuin\u0163\u0103 \u015fi nu mai are unde s\u0103 stea, pentru c\u0103 nu-\u0219i permite s\u0103 pl\u0103teasc\u0103 \u0219i o chirie\u201d, subliniaz\u0103 Mihaela Grigore.<br \/>\nNistor Boc\u0103neal\u0103 precizeaz\u0103 c\u0103, atunci c\u00e2nd vine vorba de stabilirea unei clauze de penalizare, clientul trebuie s\u0103 priveasc\u0103 contractul per-ansamblul s\u0103u, pentru c\u0103 sunt prevederi ce rezult\u0103 implicit din al\u0103turarea mai multor paragrafe. Directorul Metropolitan Business ofer\u0103 aici exemplul unui client din al c\u0103rui antecontract reie\u0219ea c\u0103, \u00een cazul \u00een care developerul nu livra locuin\u021ba la termen, acesta avea de pl\u0103tit o penalizare total\u0103 de un euro. \u00cen contrapunct, Boc\u0103neal\u0103 poveste\u0219te \u0219i despre un antecontract foarte bine \u00eentocmit. Astfel, pentru un apartament nou \u00een valoare de 800.000 de euro s-a stabilit o penalizare de 200.000 de euro \u00een cazul nerespect\u0103rii termenului de execu\u021bie. La aceast\u0103 sum\u0103 se mai ad\u0103uga o sum\u0103 pe care constructorul trebuia s\u0103 o pl\u0103teasc\u0103 zilnic dup\u0103 expirarea termenului de finalizare a p\u0103r\u021bilor comune din cadrul ansamblului.<\/p>\n<p><strong>Detalii despre suprafa\u021b\u0103 \u0219i finisaje<\/strong><br \/>\nUn alt risc pe care \u0219i-l asum\u0103 un cump\u0103r\u0103tor la cump\u0103rarea unei locuin\u021be nefinalizate este ca aceasta s\u0103 nu arate deloc ca \u00een planurile developerului. De asemenea, este absolut necesar\u0103 includerea unei anexe \u00een care s\u0103 fie precizate toate detaliile legate de finisajele pe care le va avea apartamentul (marca, valoarea materialelor folosite, ce suprafa\u0163\u0103 trebuie s\u0103 acopere etc.).
