institu\u021bia ar urma s\u0103 se asigure de respectarea angajamentelor asumate, ca \u0219i de sanc\u0163ionarea dezvoltatorilor imobiliari.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Dup\u0103 discu\u021biile privitoare la legea d\u0103rii \u00een plat\u0103 \u0219i la cele despre continuarea sau oprirea programului Prima Cas\u0103, pia\u021ba reziden\u021bial\u0103 autohton\u0103 se afl\u0103 \u00een fa\u021ba unei noi ini\u021biative legislative ce are poten\u021bialul de a-i da peste cap func\u021bionarea normal\u0103. Astfel, doi deputa\u0163i PNL au depus recent la Senat, \u00een regim de urgen\u021b\u0103, un proiect de lege care include o serie de cerin\u0163e considerate \u201efundamentale\u201d pentru dezvoltatorii imobiliari.<\/p>\n<p>Potrivit Mediafax, documentul prevede ca Agen\u0163ia Na\u0163ional\u0103 pentru Locuin\u0163e (ANL) s\u0103 devin\u0103 autoritatea \u00eens\u0103rcinat\u0103 cu supravegherea respect\u0103rii normelor de protec\u0163ie a consumatorului \u00een dezvoltarea proiectelor imobiliare. Cerin\u021bele adresate dezvoltatorilor de pe pia\u021ba reziden\u021bial\u0103 sunt, \u00eens\u0103, foarte numeroase, restrictive \u0219i dificil de pus \u00een practic\u0103, av\u00e2nd poten\u021bialul de a complica foarte mult procedura birocratic\u0103 inerent\u0103 construirii unor asemenea proiecte. Acesta este motivul pentru care o asocia\u021bie a dezvoltatorilor consider\u0103 c\u0103, dac\u0103 ar fi adoptat\u0103, o asemenea lege ar avea \u201eefecte catastrofale\u201d.<\/p>\n<div class=\"entry-content-inline-styles table-responsive\">\n<strong>Din expunerea de motive a legii<\/strong><br \/>\nCei doi deputa\u0163i liberali, anume Gabriel Andronache \u015fi Florin Roman, arat\u0103 \u00een expunerea de motive a proiectului de lege c\u0103 \u201enecesitatea social\u0103 pentru reglementarea legislativ\u0103 \u00een domeniul imobiliar este stringent\u0103\u201d, \u00eentruc\u00e2t \u201eactualul cadru legislativ, restr\u00e2ns ca \u00eentindere \u015fi dispersat \u00een multe reglement\u0103ri cu putere juridic\u0103 diferit\u0103, determin\u0103 cre\u015fterea num\u0103rului reclama\u0163iilor rom\u00e2nilor care se simt \u00een\u015fela\u0163i, dar \u015fi a situa\u0163iilor \u00een care via\u0163a proprietarilor este \u00een pericol \u00een propria cas\u0103\u201d. Ace\u0219tia precizeaz\u0103, totodat\u0103, c\u0103 \u201estructurile asociative\u201d din domeniul imobiliar consider\u0103 necesar\u0103 reglementarea pie\u0163ei de dezvoltare imobiliar\u0103 \u015fi cea a construc\u0163iilor. <\/p>\n<p>\u201e\u00cen prezent, pia\u0163a imobiliar\u0103 este privit\u0103 cu suspiciune de consumatori, doar 38% au \u00eencredere c\u0103 o tranzac\u0163ie imobiliar\u0103 nu este o p\u0103c\u0103leal\u0103. Acest sector este \u00eentrecut doar de cel al ma\u015finilor second-hand, unde cump\u0103r\u0103torii au \u00eencredere doar \u00eentr-un procent de 36% c\u0103 tranzac\u0163ia este corect\u0103. \u00cen acest moment, legisla\u0163ia din domeniul construc\u0163iilor este una permisiv\u0103, ceea ce face apari\u0163ia chiar \u015fi a cazurilor \u00een care proprietarii mor incendia\u0163i \u00een propria cas\u0103. Important de men\u0163ionat c\u0103 aceast\u0103 lege nu este una \u00eempotriva dezvoltatorilor, ci \u00ee\u015fi propune s\u0103 stabileasc\u0103 un set de reguli care trebuie respectat atunci c\u00e2nd se construie\u015fte \u015fi vinde un spa\u0163iu locativ\u201d, se arat\u0103 \u00een expunerea de motive a legii.\n<\/p><\/div>\n<h2><span class=\"ez-toc-section\" id=\"Actele_pentru_fiecare_proiect_inregistrate_la_ANL_%E2%80%93_pe_faze_de_constructie\"><\/span>Actele pentru fiecare proiect, \u00eenregistrate la ANL \u2013 pe faze de construc\u021bie!<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Una dintre principalele reglement\u0103ri cuprinse \u00een ini\u021biativa legislativ\u0103 este c\u0103 fiecare proiect imobiliar va trebui \u00eenregistrat la ANL \u2013 \u00een caz contrar, dezvoltatorul va trebui s\u0103 pl\u0103teasc\u0103 o amend\u0103 de 5% (ulterior de 10%) din valoarea proiectului \u0219i nu va putea promova sau comercializa nicio unitate din respectivul ansamblu. De men\u021bionat este c\u0103 fiecare etap\u0103 de construc\u021bie este considerat\u0103 un proiect autonom, astfel c\u0103 \u00eenregistrarea la ANL ar trebui ob\u021binut\u0103 pentru fiecare faz\u0103, separat. Excep\u021bie de la regula \u00eenregistr\u0103rii la ANL vor face doar proiectele imobiliare care nu dep\u0103\u015fesc opt unit\u0103\u021bi locative, \u00een toate fazele de construc\u021bie. <\/p>\n<p>De asemenea, Agen\u0163ia Na\u0163ional\u0103 pentru Locuin\u0163e ar trebui s\u0103 gestioneze un sistem on-line pentru depunerea cererii de \u00eenregistrare a dezvolt\u0103rilor imobiliare. \u00cen cazul nerespect\u0103rii reglement\u0103rilor legii, ANL are dreptul de a anula \u00eenregistrarea proiectului \u2013 ceea ce ar echivala cu o blocare a proiectului p\u00e2n\u0103 la remedierea situa\u021biei.<\/p>\n<p>Potrivit aceluia\u0219i document, va trebui ca dezvoltatorii s\u0103 depun\u0103, tot la ANL, \u0219i actele necesare pentru construc\u0163ie, inclusiv: autoriza\u0163ia de construc\u0163ie, certificatul de urbanism, planul lucr\u0103rilor de construire, detaliile amplasamentului proiectului, modelul de contract pentru rezervare, contractul de v\u00e2nzare-cump\u0103rare \u015fi actul de transmitere propus spre a fi semnat de c\u0103tre cump\u0103r\u0103tori, numele \u015fi adresele agen\u0163ilor imobiliari care realizeaz\u0103 v\u00e2nzarea, dac\u0103 exist\u0103, numele \u015fi adresele contractan\u0163ilor\/subcontractan\u0163ilor, arhitectului, inginerului \u015fi orice alte persoane implicate \u00een dezvoltarea proiectului propus.<\/p>\n<p>O alt\u0103 prevedere important\u0103 a legii este ca cel pu\u0163in 50% din sumele \u00eencasate pentru proiectul imobiliar de la beneficiari s\u0103 fie depozitate \u00eentr-un cont separat deschis la o banc\u0103 dispus\u0103 s\u0103 acopere prin credit costul construc\u0163iei \u015fi costul terenului. <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Despagubiri_pentru_cumparator\"><\/span>Desp\u0103gubiri pentru cump\u0103r\u0103tor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Potrivit legii, informa\u021biile cu privire la proiect \u0219i la propriet\u0103\u021bile promovate trebuie s\u0103 fie corecte, clare \u0219i precise. \u00cen plus, dac\u0103 un cump\u0103r\u0103tor este afectat de o declara\u0163ie fals\u0103 sau incorect\u0103 con\u0163inut\u0103 \u00een anun\u0163ul de publicitate sau prospect sau \u00een datele tehnice privind modelul de apartament, parcel\u0103 sau cl\u0103dire, dar \u0219i dac\u0103 inten\u0163ioneaz\u0103 s\u0103 se retrag\u0103 din proiectul propus, acestuia i se restituie \u00eentreaga investi\u0163ie \u00eempreun\u0103 cu dob\u00e2nda legal\u0103, precum \u015fi o desp\u0103gubire \u00een modul prev\u0103zut \u00een prezenta lege. Pentru \u00eenc\u0103lcarea dispozi\u0163iilor legale men\u0163ionate anterior, dezvoltatorul va pl\u0103ti consumatorului p\u0103gubit 10% din valoarea locuin\u0163ei datorate consumatorului, dac\u0103 a fost \u00eenc\u0103lcat\u0103 una din prevederile cuprinse \u00een lege.<\/p>\n<p>Un aspect cu efecte pe termen mai lung este acela c\u0103, \u00een cazul \u00een care, \u00een termen de doi ani de la \u00eencheierea tranzac\u021biei, cump\u0103r\u0103torul aduce la cuno\u0219tin\u021ba dezvoltatorului \u201eorice defect structural sau orice defect \u00een manoper\u0103, calitate sau prestarea de servicii sau alte obliga\u0163ii ale dezvoltatorului, conform promisiunii de v\u00e2nzare\u201d, acesta din urm\u0103 va avea obliga\u021bia s\u0103 remedieze problemele f\u0103r\u0103 taxe suplimentare, \u00een termen de treizeci de zile de la constatare. \u00cen caz contrar, cump\u0103r\u0103torii afecta\u0163i au dreptul s\u0103 primeasc\u0103 o desp\u0103gubire corespunz\u0103toare, \u00een modul prev\u0103zut de legea \u00een discu\u021bie.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"ADIRU_Cresterea_birocratiei_va_genera_intarzieri_si_majorari_de_costuri\"><\/span>ADIRU: Cre\u0219terea birocra\u021biei va genera \u00eent\u00e2rzieri \u0219i major\u0103ri de costuri<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>\u00cen contextul acestei propuneri legislative, reprezentan\u021bii Asocia\u021biei Dezvoltatorilor Imobiliari din Rom\u00e2nia \u2013 Urbanis (ADIRU) consider\u0103 c\u0103 \u201eadoptarea acestei legi va produce efecte catastrofale pentru pia\u021ba imobiliar\u0103, chiar mai accentuate dec\u00e2t cele care au fost produse de criza imobiliar\u0103 de acum zece ani, deoarece va conduce la trecerea de la o pia\u021b\u0103 liber\u0103 \u0219i concuren\u021bial\u0103, la o pia\u021b\u0103 cu caracter monopolist \u0219i strict reglementat, care ar r\u0103m\u00e2ne \u00een acest fel pe o perioad\u0103 nedeterminat\u0103 de timp\u201d.  <\/p>\n<p>Oficialii asocia\u021biei puncteaz\u0103, de asemenea, c\u0103 activitatea dezvoltatorilor imobiliari din Rom\u00e2nia este deja monitorizat\u0103 de c\u0103tre Protec\u021bia Consumatorilor, ISC, ANAF, ANSPDCP, ca \u0219i de prim\u0103riile locale sau de Poli\u021bia Local\u0103. \u201eIntroducerea unui nou organ de reglementare, cum este ANL, ar duce la distrugerea rapid\u0103 a pie\u021bei imobiliare din Rom\u00e2nia. Oricum, introducerea unei pie\u021be reglementate \u00een domeniul imobiliar, cu o autoritate de autorizare \u0219i control, ar fi unic\u0103 \u00een Europa, unde aceast\u0103 pia\u021b\u0103 este reglementat\u0103 prin legi, a\u0219a cum este \u0219i \u00een Rom\u00e2nia, dar nu supus\u0103 autoriz\u0103rii \u0219i controlului unui astfel de organ\u201d. La nivel interna\u021bional exist\u0103 doar c\u00e2teva \u021b\u0103ri care au astfel de organisme: India, Bahrain, Dubai, precizeaz\u0103 ace\u0219tia.<\/p>\n<p>\u201eCre\u0219terea birocra\u021biei va conduce la \u00eent\u00e2rzieri \u0219i cre\u0219teri de costuri \u0219i va limita pia\u021ba la doar c\u00e2\u021biva juc\u0103tori importan\u021bi care vor avea logistica necesar\u0103 pentru a \u00eendeplini sutele de noi cerin\u021be din propunerea legislativ\u0103 \u0219i care \u0219i-ar putea asuma riscul pl\u0103\u021bii unor amenzi de 10%-20% din valoarea unui proiect.
