total.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Cel pu\u021bin teoretic, cea mai recent\u0103 variant\u0103 a programului Noua Cas\u0103 (\u00eenlocuitorul longevivului Prima Cas\u0103) \u00ee\u0219i propune s\u0103 ofere rom\u00e2nilor posibilitatea de a achizi\u021biona locuin\u021be mai spa\u021bioase. \u201eSuprafa\u021ba predat\u0103 de c\u0103tre dezvoltatorii imobiliari este cea mai mic\u0103 din ultimii 20 de ani, adic\u0103 de 63 de metri p\u0103tra\u021bi. Din cele 298.000 de locuin\u021be achizi\u021bionate de c\u0103tre rom\u00e2nii din 2009 p\u00e2n\u0103 \u00een prezent [prin Prima Cas\u0103], 75% sunt cu dou\u0103 camere \u0219i doar un procent de 4% au patru camere. Deci este clar c\u0103 acest program, pe l\u00e2ng\u0103 impactul economic, pentru c\u0103 suma este dubl\u0103 fa\u021b\u0103 de ce era p\u00e2n\u0103 \u00een prezent, are \u0219i un impact din punct[ul] de vedere al arhitecturii unei locuin\u021be\u201d, a declarat recent, pentru Mediafax, Dumitru Nancu, directorul Fondului Na\u021bional de Garantare a Creditelor pentru \u00centreprinderi Micii \u0219i Mijlocii (FNGCIMM).  <\/p>\n<p><strong>Cite\u0219te \u0219i:<br \/>\n<a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/imoexpert\/noua-casa-in-sfarsit-la-start-impactul-scontat-de-jucatorii-din-piata-rezidentiala_db\/\">Noua Cas\u0103, \u00een sf\u00e2r\u0219it la start? Impactul scontat de juc\u0103torii din pia\u021ba reziden\u021bial\u0103<\/a><\/strong><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Legatura_dintre_spatiul_locativ_si_natalitate\"><\/span>Leg\u0103tura dintre spa\u021biul locativ \u0219i natalitate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Cum v\u0103d aceast\u0103 situa\u021bie dezvoltatorii imobiliari? Antoanela Com\u0219a, directorul general al Gran Via Rom\u00e2nia, recunoa\u0219te c\u0103 tendin\u021ba de a achizi\u021biona apartamente de dimensiuni mai reduse, \u00een special cu dou\u0103 camere, reprezint\u0103 o problem\u0103 pentru societatea actual\u0103, \u00een contextul \u00een care tinerii \u201e\u00eent\u00e2rzie decizia de a face un copil \u2013 sau de a face doi \u2013 pentru c\u0103 nu au spa\u021biul locativ necesar\u201d.<\/p>\n<p>Din acest punct de vedere, reprezentanta companiei consider\u0103 c\u0103 pia\u021ba reziden\u021bial\u0103 autohton\u0103 ar fi beneficiat, mai degrab\u0103, de pe urma major\u0103rii plafonului maxim de aplicare a cotei reduse de TVA (5%, \u00een loc de cota normal\u0103 de 19%). \u201eEste \u0219i observa\u021bia noastr\u0103 proprie, dar [aceasta a reie\u0219it] \u0219i din discu\u021biile cu ceilal\u021bi dezvoltatori imobiliari\u201d, a declarat Com\u0219a, \u00een cadrul celui mai recent webinar marca CPI organizat de <strong><a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/\">Imobiliare.ro<\/a><\/strong>. Ea a ar\u0103tat c\u0103 legisla\u021bia actual\u0103 este extrem de limitativ\u0103 pentru poten\u021bialii cump\u0103r\u0103tori, av\u00e2nd \u00een vedere c\u0103 majoritatea apartamentelor (noi) cu trei camere dep\u0103\u0219esc, ast\u0103zi, pragul de 450.000 de lei prev\u0103zut pentru acordarea acestei facilit\u0103\u021bi fiscale. \u201e\u0218i aici vorbesc \u00een principal de marile ora\u0219e \u2013 unde, de altfel, se \u0219i dezvolt\u0103 foarte mult\u201d, a precizat repezentanta dezvoltatorului spaniol. <\/p>\n<p><strong>Cite\u0219te \u0219i:<br \/>\n<a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/imoexpert\/dupa-noua-casa-a-venit-momentul-majorarii-plafonului-pentru-tva-5-opinia-dezvoltatorilor_db\/\">Dup\u0103 Noua Cas\u0103, a venit momentul major\u0103rii plafonului pentru TVA 5%. Opinia dezvoltatorilor<\/a><\/strong><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Limitari_mai_exista_si_la_Noua_Casa\"><\/span>Limit\u0103ri mai exist\u0103 \u0219i la Noua Cas\u0103<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Pe de alt\u0103 parte, \u0219i noua variant\u0103 a programului Noua Cas\u0103 p\u0103streaz\u0103 unele restric\u021bii din punctul de vedere al sspa\u021biului locativ \u2013 dat fiind c\u0103 persoanele care au de\u021binut, inclusiv \u00eempreun\u0103 cu so\u021bul ori so\u021bia, o locuin\u021b\u0103 mai mare de 50 de metri p\u0103tra\u021bi nu mai pot contracta un credit cogarantat de c\u0103tre stat. \u201e\u0218tim cu to\u021bii c\u0103 legea locuin\u021belor, legea 114, spune foarte clar: un apartament cu dou\u0103 camere trebuie s\u0103 aib\u0103 o suprafa\u021b\u0103 util\u0103 52 de metri p\u0103tra\u021bi\u201d, a subliniat Com\u0219a. Ea a punctat c\u0103, \u00een aceste condi\u021bii, singurii (fo\u0219ti) proprietari de locuin\u021be care ar putea s\u0103 mai acceseze programul ar fi cei care au sau au avut doar o garsonier\u0103 \u2013 sau, ar fi de ad\u0103ugat, un apartament cu dou\u0103 camere de dimensiuni mai reduse, de tip confort doi sau trei. <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Achizitii_pe_persoana_juridica_sau_%E2%80%9Ela_gri%E2%80%9D\"><\/span>Achizi\u021bii pe persoan\u0103 juridic\u0103 sau \u201ela gri\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Reprezentan\u021bii statului sunt, desigur, la curent cu dorin\u021ba dezvoltatorilor, exprimat\u0103 \u00een repetate r\u00e2nduri, ca plafonul pentru cota redus\u0103 de TVA s\u0103 fie majorat. \u201eAm avut ni\u0219te discu\u021bii cu guvernan\u021bii no\u0219tri, cu reprezentan\u021bii Ministerului de Finan\u021be, care au zis c\u0103 trebuie s\u0103 \u0219tie care va fi impactul acestei m\u0103suri asupra bugetului. Noi venim \u0219i spunem c\u0103 impactul nu va fi foarte mare\u201d, a spus reprezentanta Gran Via. Argumentul s\u0103u este c\u0103 cei care doresc s\u0103 achizi\u021bioneze azi locuin\u021be mai spa\u021bioase, dar se lovesc de problema TVA-ului de 19%, apeleaz\u0103, oricum, la anumite subterfugii. \u201eUnul din \u00abartificiile\u00bb existente ast\u0103zi pe pia\u021b\u0103 este achizi\u021bionarea acestor apartamente pe persoan\u0103 juridic\u0103. Oamenii \u00ee\u0219i deschid o firm\u0103, costurile sunt destul de mici, 200 de lei capital social, mai pl\u0103te\u0219ti un contabil 150 de euro, dar economise\u0219ti acei 19%, av\u00e2nd a\u0219a-numita taxare invers\u0103\u201d, a explicat Com\u0219a. <\/p>\n<p><strong>Cite\u0219te \u0219i:<br \/>\n<a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/imoexpert\/plafonul-pentru-5-tva-la-locuinte-o-problema-pentru-piata-si-in-2019_db\/\">Plafonul pentru 5% TVA la locuin\u021be, o problem\u0103 pentru pia\u021b\u0103 \u0219i \u00een 2019?<\/a><\/strong><\/p>\n<p>O alt\u0103 solu\u021bie, la care apeleaz\u0103 dezvoltatorii \u0219i cump\u0103r\u0103torii deopotriv\u0103, este reprezentat\u0103 de v\u00e2nzarea \u0219i, respectiv, achizi\u021bia unor locuin\u021be \u201ela gri\u201d, clien\u021bii ocup\u00e2ndu-se ulterior pe cont propriu de finalizarea acestora. \u201eCodul fiscal permite acest lucru, s\u0103 aplic TVA-ul de 5% dac\u0103 apartamentul este locuibil \u2013 \u00ablocuibil\u00bb \u00eenseamn\u0103 c\u0103 am geamuri, am u\u0219\u0103 de intrare, am obiectele sanitare la baie [\u2026] \u0219i, bine\u00een\u021beles, instala\u021biile realizate; nu trebuie s\u0103 am parchet, nu trebuie s\u0103 am radiatoare (trebuie s\u0103 am centrala sau ceva care s\u0103-mi asigure apa cald\u0103, [dar] pot s\u0103 m\u0103 \u00eenc\u0103lzesc cu ni\u0219te radiatoare electrice), nu trebuie s\u0103 am u\u0219i interioare, nu trebuie s\u0103 am pere\u021bii vopsi\u021bi \u0219.a.m.d.\u201d, a mai ar\u0103tat reprezentanta Gran Via. <\/p>\n<h2><span class=\"ez-toc-section\" id=\"Doua_apartamente_mai_mici_lipite\"><\/span>Dou\u0103 apartamente mai mici, lipite<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>O a treia metod\u0103 folosit\u0103 de rom\u00e2nii care \u00ee\u0219i doresc o locuin\u021b\u0103 nou\u0103 mai spa\u021bioas\u0103, \u00eens\u0103 f\u0103r\u0103 a fi nevoi\u021bi s\u0103 scoat\u0103 din buzunar \u00eenc\u0103 o cincime din pre\u021bul acesteia, const\u0103 \u00een achizi\u021bia a dou\u0103 apartamente cu suprafe\u021be mai mici, al\u0103turate, care s\u0103 poat\u0103 fi unite ulterior. \u201eAm avut \u0219i noi [cazuri] \u00een care clien\u021bii au cump\u0103rat dou\u0103 apartamente \u0219i dup\u0103 aceea \u0219i-au f\u0103cut [singuri anumite] lucr\u0103ri: au d\u0103r\u00e2mat un zid care nu era de rezisten\u021b\u0103 sau au f\u0103cut o u\u0219\u0103 \u0219i \u0219i-au realizat un apartament cu patru camere \u2013 dar ei, \u00een documenta\u021bia cadastral\u0103, de\u021bin dou\u0103 apartamente cu dou\u0103 camere\u201d, a subliniat Com\u0219a. <\/p>\n<blockquote><p>\u201eLimita actual\u0103 pentru aplicarea TVA de 5% duce la o calitate slab\u0103 a locuirii, care se traduce prin suprafe\u021be mici \u0219i o calitate mai redus\u0103 a materialelor de executare a lucr\u0103rilor de construc\u021bii. \u00cen acela\u0219i timp, vorbim de o m\u0103sur\u0103 discriminatorie, prin care \u00abpenaliz\u0103m\u00bb familiile cu mai mul\u021bi membri, care sunt nevoite s\u0103 locuiasc\u0103 \u00eenghesuite \u00eentr-un apartament cu dou\u0103 camere. \u00cen aceste condi\u021bii, multe familii vor am\u00e2na decizia de a avea copii pentru c\u0103 nu le pot asigura condi\u021bii de locuire decente. Cum evolueaz\u0103 cele patru proiecte reziden\u021biale ale unui dezvoltator cu circa 1.800 de locuin\u021be finalizate<\/a><\/a><\/strong><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Ce_solutii_se_aplica_in_alte_tari_europene\"><\/span>Ce solu\u021bii se aplic\u0103 \u00een alte \u021b\u0103ri europene?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>\u00cen cea mai recent\u0103 edi\u021bie a raportului de pia\u021b\u0103 publicat trimestrial de <strong><a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/\">Imobiliare.ro<\/a><\/strong> \u0219i <strong><a class=\"article-body-links\"href=\"https:\/\/www.analizeimobiliare.ro\/\">Analize Imobiliare<\/a><\/strong>, reprezentanta dezvoltatorului spaniol a ar\u0103tat c\u0103 majorarea plafonului pentru aplicarea TVA de 5% este \u201e\u00een linie\u201d cu reglement\u0103rile din alte \u021b\u0103ri  europene.
