Acesta reprezint\u0103 dovada achit\u0103rii unui avans \u015fi, totodat\u0103, \u00ee\u0163i ofer\u0103 garan\u0163ia c\u0103 proprietarul nu va \u00eenstr\u0103ina locuin\u0163a p\u00e2n\u0103 c\u00e2nd tu nu vei avea dosarul de credit aprobat.<\/p>\n<p>\u00cenainte de semnarea unui precontract \u00eens\u0103, orice cump\u0103r\u0103tor ar trebui s\u0103-\u015fi ia anumite m\u0103suri de precau\u0163ie. <a class=\"article-body-links\"href=\"http:\/\/comunitate.imobiliare.ro\/IonutButoi\/\">Ionu\u0163 Butoi<\/a>, director de dezvoltare \u00een cadrul Bursei Rom\u00e2ne de Crean\u0163e, spune c\u0103, mai \u00eent\u00e2i de toate, clientul interesat trebuie s\u0103 se asigure c\u0103 proprietarul locuin\u0163ei dispune de toate actele necesare la notar (acte de proprietate, cadastru, intabulare). Asta pentru c\u0103, dac\u0103 aceste documente nu sunt \u00een regul\u0103, p\u00e2n\u0103 la rezolvarea problemelor poten\u0163ialul cump\u0103r\u0103tor poate pierde finan\u0163area. O alt\u0103 dovad\u0103 pe care proprietarul trebuie s\u0103 o prezinte \u0163ine de faptul c\u0103 imobilul respectiv nu este grevat de sarcini (ipoteci). \u00cen caz contrar, \u00een ciuda achit\u0103rii unui avans, o astfel de locuin\u0163\u0103 nu poate fi v\u00e2ndut\u0103 de proprietar (<a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/articole\/vanzarea-imobilelor-ipotecate_db\/\">cu excep\u0163ia \u00een care acesta dispune de acordul b\u0103ncii<\/a>).<\/p>\n<p><a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2010\/09\/semnarecontract.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-6715\" src=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2010\/09\/semnarecontract-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" \/><\/a><strong>Nu face chitan\u0163e de m\u00e2n\u0103, mergi la notariat!<\/strong><br \/>\nIonu\u0163 Butoi precizeaz\u0103 c\u0103 este extrem de important ca orice promisiune de v\u00e2nzare s\u0103 fie \u00eencheiat\u0103 prin notariat. \u00cen acest fel, documentul este \u00eenregistrat la Cartea Funciar\u0103, iar proprietarul nu mai poate \u00eencheia \u00een mod legal niciun alt antecontract p\u00e2n\u0103 la expirarea celui aflat \u00een vigoare. \u00cen aceast\u0103 situa\u0163ie, \u00een cazul \u00een care proprietarul se r\u0103zg\u00e2nde\u015fte \u015fi nu vrea s\u0103 restituie banii de avans (sau suma stabilit\u0103 prin antecontract), se pune sechestru pe cas\u0103 \u015fi se trece la lichidarea imobilului. \u201eCu chitan\u0163\u0103 de m\u00e2n\u0103, proprietarul poate vinde casa de zece ori p\u00e2n\u0103 s\u0103 po\u0163i dovedi ceva\u201d, subliniaz\u0103 Butoi.<\/p>\n<p>\u00cen ceea ce prive\u015fte clauzele ce ar trebui incluse efectiv \u00een antecontract, <a class=\"article-body-links\"href=\"http:\/\/comunitate.imobiliare.ro\/florian\/\">Florian Petrache<\/a>, broker \u00een cadrul Indoors Real Estate Grup, spune c\u0103 una dintre cele mai importante este reprezentat\u0103 de perioada stabilit\u0103 pentru achitarea integral\u0103 a locuin\u0163ei. \u201eEste bine s\u0103 se ia un termen acoperitor de o lun\u0103 \u015fi jum\u0103tate-dou\u0103. A\u015fa este cel mai bine, pentru c\u0103 aprobarea unui dosar prin Prima Cas\u0103 dureaz\u0103 cam o lun\u0103\u201d, subliniaz\u0103 Petrache. La r\u00e2ndul s\u0103u, Ionu\u0163 Butoi recomand\u0103 un termen \u015fi mai mare, de circa trei luni de zile pentru un antecontract, pentru a avea o deplin\u0103 siguran\u0163\u0103 cu privire la \u00eencheierea tranzac\u0163iei.<\/p>\n<p><strong>Obligatorie: clauza de restituire a avansului<\/strong><br \/>\nO alt\u0103 clauz\u0103 absolut necesar\u0103 prevede obliga\u0163ia de restituire a avansului pl\u0103tit \u00een cazul \u00een care v\u00e2nz\u0103torul se r\u0103zg\u00e2nde\u015fte sau \u00een alte situa\u0163ii ce nu depind de cump\u0103r\u0103tor. \u201eExist\u0103 posibilitatea ca FNGCIMM (Fondul Na\u0163ional de Garantare a Creditelor pentru IMM) s\u0103 resping\u0103 dosarul\u201d, spune Florian Petrache. \u00cen astfel de cazuri, promitentul-cump\u0103r\u0103tor trebuie s\u0103 se asigure c\u0103-\u015fi va primi integral banii \u00eenapoi. O astfel de clauz\u0103 poate func\u0163iona \u015fi \u00een sens invers.
