Vor putea fi achizi\u021bionate cu TVA 9% locuin\u021be cu o suprafa\u021b\u0103 util\u0103 de cel mult 120 de mp, exclusiv anexele gospod\u0103re\u0219ti, a c\u0103ror valoare, inclusiv a terenului pe care sunt construite, nu dep\u0103\u0219e\u0219te suma de 600.000 de lei, exclusiv TVA, ce \u00een momentul livr\u0103rii pot fi locuite ca atare. Ce \u00eenseamn\u0103, de fapt, acest &#8222;ca atare&#8221;? Documentul publicat de Ministerul Finan\u021belor include detalii:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>locuin\u021bele au acces liber individual la spa\u021biul locuibil, f\u0103r\u0103 tulburarea posesiei \u0219i a folosin\u021bei exclusive a spa\u021biului de\u021binut de c\u0103tre o alt\u0103 persoan\u0103 sau familie<\/li>\n\n\n\n<li>acces la energia electric\u0103 \u0219i ap\u0103 potabil\u0103, evacuarea controlat\u0103 a apelor uzate \u0219i a reziduurilor menajere<\/li>\n\n\n\n<li>sunt formate cel pu\u021bin dintr-un spa\u021biu de odihn\u0103, un spa\u021biu pentru preg\u0103tirea hranei \u0219i un grup sanitar<\/li>\n\n\n\n<li>finisajele exterioare includ cel pu\u021bin \u2013 acoperi\u0219 dac\u0103, \u00een func\u021bie de tipul construc\u021biei, este prev\u0103zut acest element constructiv, geamuri, u\u0219\u0103 de\/la intrare<\/li>\n\n\n\n<li>finisajele interioare includ cel pu\u021bin \u2013 pere\u021bi finisa\u021bi cu vopsea, tapet, faian\u021b\u0103 sau alte elemente utilizate pentru finisare, podele finisate cu gresie, parchet sau alte elemente utilizate pentru finisare, u\u0219i interioare, \u00een func\u021bie de proiect<\/li>\n\n\n\n<li>instala\u021bii sanitare \u0219i obiecte sanitare, respectiv vas WC, lavoar \u0219i sp\u0103l\u0103tor cu cuv\u0103, cu bateriile aferente<\/li>\n\n\n\n<li>instala\u021bii electrice, inclusiv tablou, doze, \u00eentrerup\u0103toare\/comutatoare \u0219i prize.<\/li>\n<\/ul>\n\n\n\n<p>Se dore\u0219te, totodat\u0103, restr\u00e2ngerea facilit\u0103\u021bilor fiscale acordate angaja\u021bilor din construc\u021bii pentru un singur contract individual de munc\u0103, cu norm\u0103 \u00eentreag\u0103 sau cu timp par\u0163ial, la nivel de angajat, la un singur angajator\/pl\u0103titor de venit, pentru veniturile din salarii \u015fi asimilate salariilor de p\u00e2n\u0103 la 10.000 lei, brut. Mai mult, se propune eliminarea scutirii de la plata contribu\u021biilor sociale de s\u0103n\u0103tate pentru cei care activeaz\u0103 \u00een acest domeniu.<\/p>\n\n\n\n<p>Un impozit special va fi pl\u0103tit, totodat\u0103, de c\u0103tre persoanele care au \u00een proprietate cl\u0103diri reziden\u021biale cu o valoare ce dep\u0103\u0219e\u0219te 2,5 milioane de lei, echivalentul a circa 503.000 de euro. \u00cen acest caz, se propune aplicarea unei cote de 0,3% asupra diferen\u021bei dintre valoarea impozabil\u0103 a cl\u0103dirii comunicate de c\u0103tre organul fiscal local prin decizia de impunere \u0219i plafonul de 2,5 milioane de lei.<\/p>\n\n\n\n<p>Acestea sunt doar c\u00e2teva dintre m\u0103surile cuprinse \u00een cadrul proiectului de lege. Autorit\u0103\u021bile estimeaz\u0103 c\u0103 toate modific\u0103rile propuse vor avea un impact financiar pozitiv de peste 22,9 miliarde de lei, \u00een medie pe urm\u0103torii cinci ani.<\/p>\n\n\n\n<p>Iat\u0103 cum v\u0103d speciali\u0219tii din domeniul imobiliar poten\u021bialul impact al noilor m\u0103suri propuse at\u00e2t la nivelul segmentului de dezvoltare reziden\u021bial\u0103, c\u00e2t \u0219i \u00een privin\u021ba comportamentului cump\u0103r\u0103torilor.<\/p>\n\n\n\n<p><strong>Antoanela Com\u0219a, pre\u015fedintele Gran Via Rom\u00e2nia<\/strong>:<\/p>\n\n\n\n<p>Dup\u0103 apari\u021bia \u00een mediul online, \u0219i nu numai, a diverse propuneri de modific\u0103ri fiscal\u2013bugetare, vedem acum o variant\u0103 foarte mult \u201c\u00eendulcit\u0103\u201d. Personal nu sunt convins\u0103 c\u0103 aceste m\u0103suri vor ajuta \u00een totalitate \u00een ceea ce prive\u0219te deficitul.<\/p>\n\n\n\n<p>\u00cen ceea ce prive\u0219te piata imobiliar\u0103, au fost vehiculate cre\u0219teri de taxe, apari\u021bia unor taxe noi, cre\u0219teri de TVA, impozite \u0219i altele.&nbsp;Dintre toate acestea, singurele m\u0103suri regasite \u00een ultima variant\u0103 sunt:<\/p>\n\n\n\n<p>&#8211;<em>Cre\u0219terea TVA de la 5% la 9%.<\/em> Este o cre\u0219tere, \u00eentr-adev\u0103r, ce poate ajunge p\u00e2n\u0103 la 24.000 de lei (600.000 x 4%). Pe de alt\u0103 parte, pentru promisiunile \u00een vigoare \u0219i pentru cele ce se vor semna \u0219i se va achita un avans p\u00e2n\u0103 la data de 31.12.2023, dac\u0103 se va semna contractul de v\u00e2nzare \u2013 cump\u0103rare \u00een form\u0103 autentic\u0103 \u00een anul 2024, cota de TVA aplicabil\u0103 va fi tot de 5%. Practic, <strong>aceast\u0103 m\u0103sur\u0103 va afecta din p\u0103cate acele persoane\/familia cu venituri sub medie<\/strong>. Pe termen scurt, nu cred c\u0103 pia\u021ba va fi foarte afectat\u0103, dat fiind faptul c\u0103 deja are c\u00e2teva probleme cauzate de cre\u0219terile de pre\u021buri \u0219i de cre\u0219terile costurilor de finan\u021bare. Cei cu venituri mici, ce au avut oricum probleme \u00een a achizi\u021biona o proprietate din cauza cre\u0219terii de pre\u021buri \u0219i cre\u0219terii costului de finan\u021bare, vor r\u0103m\u00e2ne \u00een acela\u0219i scenariu. Cei cu venituri medii \u0219i peste medie vor pl\u0103ti, cu siguran\u021b\u0103, aceste diferen\u021be \u2013 surse proprii sau se pot \u00eemprumuta la b\u0103nci.<\/p>\n\n\n\n<p>&#8211;<em>Stabilirea condi\u021biilor de aplicare a cotei de TVA 5%<\/em>. Apar modific\u0103ri \u00een Codul Fiscal, \u00een sensul modific\u0103rii articolulului 266 alineatul (1), punctul 16^1 care define\u0219te clar \u201clocuin\u021be care \u00een momentul livr\u0103rii pot fi locuite ca atare\u201d. <strong>Ast\u0103zi avem tot felul de \u201cstadii\u201d ale locuin\u021belor \u2013 la ro\u0219u, la gri, la alb, finisate. Acest lucru nu cred c\u0103 este corect \u0219i creeaz\u0103 confuzie la nivelul clientului final, dat fiind c\u0103 el nu poate compara corect pre\u021burile din pia\u021b\u0103.<\/strong> Practic, m\u0103surile propuse vor specifica foarte clar faptul c\u0103 aceast\u0103 cota de TVA redus\u0103 \u2013 5% sau 9% &#8211; se poate aplica doar dac\u0103 apartamentul este finalizat. Avem \u0219i o lege \u00een acest sens, legea locuin\u021bei 114\/1996 cu complet\u0103rile ulterioare, care practic nu ar fi trebuit s\u0103 lase loc de interpret\u0103ri. Prin aceasta precizare, Guvernul stabile\u0219te clar regulile \u00een care se poate aplica cota redus\u0103 de TVA.<\/p>\n\n\n\n<p><em>-Impozitul suplimentar de 0,3 % <\/em>aplicat diferentei \u00eentre valoarea impozabil\u0103 a unei cl\u0103diri \u0219i 2.500.000 lei. Aici, personal nu cred c\u0103 vom avea multe locuin\u021be \u00eencadrate pentru c\u0103 valoarea locuin\u021bei se calculeaz\u0103 \u00een conformitate cu articolul 457 din Codul Fiscal \u0219i nu \u00een conformitate cu valoarea de evaluare. Astfel, se pleac\u0103 de la o valoare de maximum 1.000 lei\/mp construit. Aceast\u0103 valoare se ajusteaz\u0103 \u00een func\u021bie de rangul localit\u0103\u021bii \u0219i zona \u00een care este amplasat\u0103 cl\u0103direa, prin \u00eenmul\u021birea valorii de 1.000 RON cu ni\u0219te coeficien\u021bi. Cel mai mare coeficient existent \u00een codul fiscal \u2013 cl\u0103dire rang A, zona 0, este de 2,6. Astfel, rezult\u0103 un pre\u021b de cel mult 2.600 lei\/mp construit. Dac\u0103 \u00eemp\u0103r\u021bim cei 2.500.000 lei la 2.600 lei\/mp construit, rezult\u0103 c\u0103 ar trebui s\u0103 avem imobile cu suprafa\u021b\u0103 construit\u0103 mai mare de 960 mp pentru a se achita acest impozit. C\u00e2te astfel de case crede\u021bi c\u0103 sunt \u00een Rom\u00e2nia?<\/p>\n\n\n\n<p><em>-\u00cen ceea ce prive\u0219te facilit\u0103\u021bile din construc\u021bii,<\/em> aici depinde ce vor face firmele de construc\u021bii. Problema apare \u00eens\u0103 pe fondul faptului c\u0103 aveam un deficit de muncitori califica\u021bi \u00een construc\u021bii \u0219i \u00eenainte de aceste m\u0103suri. \u00cen condi\u021biile \u00een care vedem \u021b\u0103ri precum Marea Britanie, Germania \u0219i nu numai care au planuri de atragere a for\u021bei de munc\u0103 \u00een construc\u021bii, <strong>putem avea surpriza c\u0103 nu vom avea cu cine s\u0103 realiz\u0103m lucr\u0103rile. Iar dac\u0103 totu\u0219i firmele vor decide s\u0103 suporte ace\u0219te cre\u0219teri, atunci le vom reg\u0103si \u00een cre\u0219teri de cost al manoperei, cost ce reprezint\u0103 p\u00e2n\u0103 la 40% din costul construc\u021biei.<\/strong><\/p>\n\n\n\n<p>Cred c\u0103 nu putem avea \u201co \u021bar\u0103 ca afar\u0103\u201d cu taxe \u0219i impozite foarte mici. \u0218i un alt aspect, avem tendin\u021ba s\u0103 facem compara\u021bii cu cea mai favorabil\u0103 situa\u021bie. A\u0219a cum ar trebui s\u0103 ne aducem aminte c\u0103 au fost \u0219i dob\u00e2nzi bancare de peste 10%-12%, la fel au fost \u0219i impozite de p\u00e2n\u0103 la 40%. Dac\u0103 ne uit\u0103m la taxele \u0219i impozitele din vestul Europei, ce s\u0103 mai spun.<\/p>\n\n\n\n<p><strong>Bogdan Iliescu, Director Comercial&nbsp;Nusco&nbsp;Imobiliara<\/strong>:<\/p>\n\n\n\n<p>Consider c\u0103 noile m\u0103suri fiscal-bugetare vor afecta at\u00e2t micii \u00eentreprinz\u0103tori, c\u00e2t \u0219i marile companii. Dar, din p\u0103cate, cei mai afecta\u021bi vor fi poten\u021bialii clien\u021bi care au nevoie ca \u00een urm\u0103toarea perioad\u0103 s\u0103 \u00ee\u0219i cumpere o locuin\u021b\u0103 nou\u0103. Consider, totodat\u0103, c\u0103 sectorul imobiliar este cel mai afectat, prin cre\u0219terea TVA-ului \u0219i introducerea de noi impozite.<\/p>\n\n\n\n<p>M\u0103surile au impact deopotriv\u0103 asupra cump\u0103r\u0103torilor, c\u00e2t \u0219i asupra dezvoltatorilor\/proprietarilor de imobile. Cu siguran\u021b\u0103, pe termen scurt, aceste m\u0103suri vor descuraja tranzac\u021biile imobiliare. <strong>Cre\u0219terea fiscaliz\u0103rii cred c\u0103 va avea un efect de majorare a pre\u021burilor finale. Majorarea TVA-ului \u0219i eliminarea subven\u021biilor din construc\u021bii vor pune \u0219i mai mult\u0103 presiune pe pia\u021b\u0103<\/strong> \u0219i, posibil, vor avea un impact negativ asupra bugetului public.<\/p>\n\n\n\n<p>At\u00e2t faptul c\u0103 TVA-ul de 5% este la a treia schimbare \u00een tot at\u00e2\u021bia ani, c\u00e2t \u0219i faptul c\u0103 acum se dore\u0219te majorarea lui, fac ca planurile dezvoltatorilor s\u0103 fie serios puse la \u00eencercare, mai ales dac\u0103 lu\u0103m \u00een considerare c\u0103 un proiect mare are nevoie de 2-3 ani s\u0103 fie finalizat &#8211; de la concept \u0219i \u00eenceperea lucr\u0103rilor p\u00e2n\u0103 la livrarea c\u0103tre clien\u021bi.<strong> Este foarte greu s\u0103 \u00ee\u021bi faci, \u00een acest sens, un plan de afaceri.<\/strong><\/p>\n\n\n\n<p>Mai ad\u0103ug\u0103m \u0219i eliminarea subven\u021biilor pentru lucr\u0103torii din domeniul construc\u021biilor \u0219i vom asista cu siguran\u021b\u0103 la o cre\u0219tere a pre\u021burilor pentru clientul final.<\/p>\n\n\n\n<p><strong>Radu Pa\u0219ca, Co-fondator Mr Exclusivitate<\/strong>:<\/p>\n\n\n\n<p><strong>Apartamentele devin mai scumpe, gener\u00e2nd costuri mai mari pentru consumatorul final \u0219i o cre\u0219tere a pre\u021burilor la locuin\u021be. <\/strong>Aceast\u0103 majorare vine odat\u0103 cu eliminarea cotei de TVA de 5%. Cu un TVA crescut la 9% pentru locuin\u021be,<strong> impactul va fi resim\u021bit cu putere de c\u0103tre persoanele cu venituri reduse, \u00een special tinerii \u0219i familiile numeroase<\/strong>, care nu \u00ee\u0219i vor mai putea permite s\u0103 cumpere locuin\u021be noi.<\/p>\n\n\n\n<p>Pentru a ilusta acest aspect, lu\u00e2nd ca exemplu un apartament cu 2-3 camere, cota de TVA majorat\u0103 la 9% va ad\u0103uga un cost suplimentar de 4.800 de euro, la care se adaug\u0103 taxele notariale calculate \u00een func\u021bie de valoarea total\u0103 a achizi\u021biei.<\/p>\n\n\n\n<p>Toate acestea se petrec \u00eentr-un context \u00een care pre\u021burile locuin\u021belor din Rom\u00e2nia au \u00eenregistrat deja o cre\u0219tere de 12% \u00een mai pu\u021bin de 2 ani.<\/p>\n\n\n\n<p>Indiferent de perspectiv\u0103,<strong> toate aceste m\u0103suri fiscale conduc temporar la o sc\u0103dere a num\u0103rului de tranzac\u021bii.<\/strong> \u00cen acela\u0219i timp, nu trebuie s\u0103 uit\u0103m c\u0103 Rom\u00e2nia se num\u0103r\u0103 printre cele mai ieftine \u021b\u0103ri din Europa \u00een ceea ce prive\u0219te fiscalitatea \u00een domeniul imobiliar. \u00cen contextul \u00een care tendin\u021ba nivelului de trai este s\u0103 se alinieze cu \u021b\u0103rile mai dezvoltate, este normal ca \u0219i partea de taxare s\u0103 evolueze. Dat fiind c\u0103 suntem \u021bara cu cei mai mul\u021bi proprietari din Europa, trebuie s\u0103 \u00eenv\u0103\u021b\u0103m s\u0103 gestion\u0103m acest lux.<\/p>\n\n\n\n<p>Pe de alt\u0103 parte, <strong>chiriile sunt \u00een cre\u0219tere din cauza faptului c\u0103 oamenii nu mai iau \u00eemprumuturi \u0219i sunt mai reticen\u021bi \u00een ceea ce prive\u0219te cump\u0103rarea de locuin\u021be<\/strong>, iar ratele la credite au \u00eenceput, \u00een anumite zone, s\u0103 fie mai mici dec\u00e2t chiria.
