Modific\u0103rile vor impacta direct at\u00e2t proprietarii, c\u00e2t \u0219i chiria\u0219ii, spun speciali\u0219tii.<\/strong><\/p>\n\n\n\n<p>&#8222;Dup\u0103 ce o relativ lung\u0103 perioad\u0103 de timp impozitarea veniturilor din chirii s-a f\u0103cut dup\u0103 c\u00e2teva reguli simple &#8211; cot\u0103 de cheltuieli forfetare (neimpozabil\u0103) de 40% din venitul brut, impozitarea cu 10% a diferen\u021bei, eliminarea obliga\u021biei de depunere la ANAF a contractului de \u00eenchiriere, anul 2023 a adus dou\u0103 schimb\u0103ri majore de procedur\u0103. Acestea au fost introduse prin OUG 16\/2022, cu aplicabilitate de la 1 ianuarie 2023 \u0219i se refer\u0103 pe de-o parte la obliga\u021bia proprietarilor de \u00eenregistrare la ANAF a tuturor contractelor de \u00eenchiriere prin formularul C 168, iar pe de alt\u0103 parte la eliminarea cotei de cheltuieli forfetare de 40%, cota de impozit de 10% urm\u00e2nd s\u0103 se aplice la venitul brut, care reprezint\u0103 venit impozabil. Asta \u00eenseamn\u0103, pe scurt, c\u0103 <strong>pentru anul 2023 impozitul pe chirie a crescut de la 6% la 10%<\/strong>&#8222;, ne-a declarat Daniel Sandu, consultant fiscal D&amp;C Conta.<\/p>\n\n\n\n<p>Din 2024 regulile se schimb\u0103 din nou. &#8222;Recentele modific\u0103ri introduse prin OUG 115\/14.12.2023 vor aduce alte<strong> trei nout\u0103\u021bi privind impozitarea veniturilor din chirii ale persoanelor fizice, cu \u00eencepere de la 1 ianuarie 2024, \u00eentr-un moment \u00een care statul nici nu a apucat s\u0103 vad\u0103 efectul modific\u0103rilor prev\u0103zute pentru 2023<\/strong>, declara\u021bia de impozit pe venit av\u00e2nd termen de depunere la 25 mai 2024&#8243;, ne-a mai explicat consultantul fiscal.<\/p>\n\n\n\n<p>Iat\u0103 care sunt modific\u0103rile care vor fi aplicate de la <strong>1 ianuarie 2024<\/strong> \u00een impozitarea veniturilor din chirii.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Reintroducerea cotei forfetare<\/strong><\/p>\n\n\n\n<p>Din 2024<strong> se reintroduce cota forfetar\u0103 de cheltuieli, dar de data aceasta<\/strong> <strong>\u00een cuantum de 20% din venitul brut.<\/strong><\/p>\n\n\n\n<p>Practic, proprietarii vor achita 10% impozit aplicat la 80% din veniturile ob\u021binute. S\u0103 lu\u0103m un exemplu concret, un apartament \u00eenchiriat de la 1 februarie pentru care este solicitat\u0103 o chirie de 500 euro\/lun\u0103. Iat\u0103 c\u00e2t pl\u0103te\u0219te proprietarul impozit \u00een 2023 \u0219i \u00een 2024, potrivit calculelor reprezentan\u021bilor agen\u021biei imobiliare Kastel Group.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"811\" height=\"243\" src=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/calcul-impozit-chirii.jpg\" alt=\"\" class=\"wp-image-68477\" srcset=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/calcul-impozit-chirii.jpg 811w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/calcul-impozit-chirii-300x90.jpg 300w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/calcul-impozit-chirii-768x230.jpg 768w\" sizes=\"auto, (max-width: 811px) 100vw, 811px\" \/><\/figure>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Re\u021binerea la surs\u0103 a impozitului<\/strong>, <strong>\u00een cazul \u00een care chiria\u0219ul este persoan\u0103 juridic\u0103<\/strong><\/p>\n\n\n\n<p>\u00cen situa\u021bia \u00een care<strong> chiria\u0219ul este o persoan\u0103 juridic\u0103 sau o alt\u0103 entitate care are obliga\u021bia de a conduce eviden\u021b\u0103 contabil\u0103 (PFA, \u00eentreprindere individual\u0103, \u00eentreprindere familial\u0103<\/strong>, etc), acesta are \u0219i obliga\u021bia de a re\u021bine \u0219i vira la bugetul de stat impozitul de<strong> 10% din venitul net<\/strong> la fiecare plat\u0103 a chiriei.<\/p>\n\n\n\n<p>Ce \u00eenseamn\u0103 acest lucru? Pentru un apartament de\u021binut de o persoan\u0103 fizic\u0103, dat \u00een chirie c\u0103tre un SRL, pentru o sum\u0103 lunar\u0103 de 500 de euro, presupun\u00e2nd un curs mediu de 5 lei\/euro, valoarea lunar\u0103 a chiriei este de 2.500 de lei, iar impozitul se calculeaz\u0103 astfel:<\/p>\n\n\n\n<p>a) <strong>pentru anul 2023<\/strong>: venitul impozabil este egal cu venitul brut de 2.500&#215;12=30.000 lei, impozit 10%=3.000 lei, care se declar\u0103 prin Declara\u021bia unic\u0103 \u0219i se pl\u0103te\u0219te p\u00e2n\u0103 la 25 mai 2024; <strong>declararea \u0219i plata sunt \u00een sarcina proprietarului<\/strong>. Suma net\u0103 r\u0103mas\u0103 proprietarului este de 27.000 de lei.<\/p>\n\n\n\n<p>b) <strong>pentru anul 2024:<\/strong> venitul impozabil=venitul brut minus cota forfetar\u0103 de cheltuieli de 20%; presupunem c\u0103 plata chiriei se face lunar, deci venitul impozabil va fi 2.500 lei-20%=2.000 lei lunar, la care impozitul de 10% va fi de 200 de lei. <strong>Declararea \u0219i plata sunt \u00een sarcina chiria\u0219ului<\/strong> persoan\u0103 juridic\u0103 sau entitate obligat\u0103 s\u0103 conduc\u0103 eviden\u021be contabile. Suma net\u0103 r\u0103mas\u0103 proprietarului este de 27.600 de lei. Diferen\u021ba de 600 de lei reprezint\u0103 exact diferen\u021ba lunar\u0103 de 50 de lei &#8211; impozit lunar 250 lei \u00een cazul (a) fa\u021b\u0103 de 200 de lei \u00een cazul (b) ori 12 luni, arat\u0103 calculele D&amp;C Conta realizate pentru <strong><a class=\"article-body-links\"href=\"http:\/\/www.imobiliare.ro\" target=\"_blank\" rel=\"noreferrer noopener\">Imobiliare.ro<\/a><\/strong>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Eliminarea \u021binerii eviden\u021bei \u00een sistemul real<\/strong><\/p>\n\n\n\n<p>Se elimin\u0103 obliga\u021bia celor care la sf\u00e2r\u0219itul unui an fiscal au \u00een derulare <strong>mai mult de 5 contracte de \u00eenchiriere<\/strong> ca \u00eencep\u00e2nd cu anul fiscal urm\u0103tor s\u0103 treac\u0103 la impozitarea \u00een sistem real, ca venituri din activit\u0103\u021bi independente.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>CASS \u00een 2024<\/strong><\/p>\n\n\n\n<p>Persoanele care ob\u021bin venituri din cedarea folosin\u021bei bunurilor pl\u0103tesc CASS \u0219i \u00een 2024 la nivelul a <strong>6, 12, respectiv 24 de salarii minime brute pe economie<\/strong>. P\u00e2n\u0103 la 6 salarii CASS nu se achit\u0103. <\/p>\n\n\n\n<p>Iat\u0103 c\u00e2t ar urma s\u0103 reprezinte CASS la un salariu minim brut de 3.300 de lei, potrivit calculelor Kastel Group.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"498\" height=\"347\" src=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/calcul-cass.jpg\" alt=\"\" class=\"wp-image-68478\" srcset=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/calcul-cass.jpg 498w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/calcul-cass-300x209.jpg 300w\" sizes=\"auto, (max-width: 498px) 100vw, 498px\" \/><\/figure>\n\n\n\n<p>**Veniturile nete se refer\u0103 la diferen\u021ba dintre veniturile brute \u0219i cota forfetar\u0103 de 20%.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Efectele modific\u0103rilor \u00een impozitarea chiriilor<\/strong><\/p>\n\n\n\n<p>Toate aceste schimb\u0103ri vor avea efecte pe mai multe paliere, \u00een opinia speciali\u0219tilor.<\/p>\n\n\n\n<p>&#8222;Un prim efect al acestor modific\u0103ri este legat de <strong>cre\u0219terea costurilor de conformare fiscal\u0103 pentru chiria\u0219i, care vor fi obliga\u021bi la o serie de activit\u0103\u021bi suplimentare <\/strong>&#8211; verific\u0103ri de cursuri valutare, calcule de impozit, o declara\u021bie fiscal\u0103 suplimentar\u0103 \u0219i o plat\u0103 \u00een plus la buget&#8221;, este de p\u0103rere consultantul fiscal Daniel Sandu.<\/p>\n\n\n\n<p>&#8222;<strong>Pentru proprietari, noua procedur\u0103 de plat\u0103 a impozitului va \u00eensemna un venit mai mic \u00een cursul anului<\/strong>, av\u00e2nd \u00een vedere c\u0103 p\u00e2n\u0103 acum ace\u0219tia puteau dispune de \u00eentreaga contravaloare a chiriei pe tot parcursul anului, p\u00e2n\u0103 la 25 mai anul viitor, care era \u0219i termen maxim de plat\u0103 a impozitului&#8221;, adaug\u0103 acesta.<\/p>\n\n\n\n<p>&#8222;\u00cen expunerea de motive din preambulul OUG 115 statul invoc\u0103 &lt;un regim fiscal echitabil&gt; prin reintroducerea cotei de cheltuieli forfetare \u0219i o reducere a sarcinii administrative at\u00e2t la nivel institu\u021bional, c\u00e2t \u0219i la nivelul persoanelor fizice care realizeaz\u0103 venituri de aceast\u0103 natur\u0103. \u00cen fapt, aceste <strong>modific\u0103ri introduse \u00eenc\u0103 \u00eenainte de a vedea efectul celor aflate deja \u00een derulare ne arat\u0103 cel pu\u021bin graba, dac\u0103 nu disperarea statului de a \u00eencasa impozitul pe chirie c\u00e2t mai repede<\/strong>, f\u0103r\u0103 s\u0103 mai a\u0219tepte termenul de 25 mai 2024. Personal, cred c\u0103 <strong>noile prevederi nu vor duce nici la cre\u0219terea num\u0103rului de contracte de \u00eenchiriere declarate, nici la cre\u0219terea \u00eencas\u0103rilor bugetare din aceast\u0103 surs\u0103, ci doar la cre\u0219terea costurilor de conformare fiscal\u0103 pentru chiria\u0219ii persoane juridice<\/strong>, c\u0103rora li s-a pus \u00een c\u00e2rc\u0103 \u00eenc\u0103 o obliga\u021bie care nu ar trebui s\u0103 fie a lor&#8221;, a mai spus Daniel Sandu.<\/p>\n\n\n\n<p>&#8222;Reintroducerea cotei forfetare reduse pentru impozitarea veniturilor din chirii \u00eencep\u00e2nd cu 2024 va aduce o reducere bun\u0103 a obliga\u021biilor fiscale ale proprietarilor \u00een compara\u021bie cu anul anterior, dar care <strong>nu acoper\u0103 valoarea CASS-ului pe care un proprietar o datoreaz\u0103<\/strong>, cu at\u00e2t mai mult cu c\u00e2t acesta se afl\u0103 \u0219i \u00een situa\u021bia \u00een care datoreaz\u0103 CASS \u0219i din alte venituri pe care le ob\u021bine independent de veniturile din chirii&#8221;, este de p\u0103rere Christian Tudorache, CEO Kastel Group.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Mai mult de jum\u0103tate dintre proprietari nu-\u0219i declar\u0103 veniturile din chirii la ANAF<\/strong><\/p>\n\n\n\n<p>Un contract de \u00eenchiriere \u00eencheiat \u00eentre proprietar \u0219i chiria\u0219 protejeaz\u0103 ambele p\u0103r\u021bi de eventuale abuzuri. Chiar \u0219i a\u0219a, de multe ori este trecut cu vederea \u0219i nu ajunge niciodat\u0103 s\u0103 fie \u00eenregistrat la Agen\u021bia Na\u021bional\u0103 de Administrare Financiar\u0103 (ANAF).<\/p>\n\n\n\n<p>&#8222;Este mai mult dec\u00e2t evident c\u0103 <strong>peste 50% dintre propriet\u0103\u021bile \u00eenchiriate \u00een Rom\u00e2nia nu sunt declarate la Administra\u021bia Financiar\u0103<\/strong>, iar pentru bugetul statului rom\u00e2n acest lucru se traduce \u00een pierderi consistente de bani&#8221;, ne-a declarat CEO-ul Kastel Group.<\/p>\n\n\n\n<p>Potrivit unui studiu Kastel Group din 2022, 33,7% dintre chiria\u0219i sus\u021bineau c\u0103 aveau contractele \u00eenregistrate la ANAF de c\u0103tre proprietari, iar al\u021bi aproape 32% nu \u0219tiau dac\u0103 documentele erau sau nu \u00eenregistrate. Circa 35% dintre responden\u021bi sus\u021bineau c\u0103 au un contract nedeclarat ori o proprietate \u00eenchiriat\u0103 mascat, sub forma unui contract de mandat sau doar printr-o \u00een\u021belegere verbal\u0103.<\/p>\n\n\n\n<p><strong>Noile schimb\u0103ri ap\u0103rute \u00een impozitarea chiriilor nu vor avea, \u00een continuare, un impact semnificativ c\u00e2nd vine vorba de obiceiul rom\u00e2nilor de a-\u0219i declara sau nu veniturile la ANAF.<\/strong><\/p>\n\n\n\n<p>&#8222;Observ\u0103m c\u0103 proprietarii care sunt obi\u0219nui\u021bi s\u0103 se conformeze legisla\u021biei fiscale \u00ee\u0219i declar\u0103 veniturile indiferent de schimb\u0103rile fiscale, \u00een timp ce proprietarii care practic\u0103 evaziunea fiscal\u0103 adesea nu \u00ee\u0219i \u00eenregistreaz\u0103 contractele, indiferent de nivelul gradului de impozitare&#8221;, spune Tudorache.<\/p>\n\n\n\n<p>&#8222;Consider c\u0103 o abordare mai eficient\u0103 ar fi s\u0103 se exploreze alternative pentru a determina proprietarii s\u0103-\u0219i declare veniturile, f\u0103r\u0103 a suprataxa pe cei care respect\u0103 legisla\u021bia fiscal\u0103&#8221;, a mai ad\u0103ugat el.<\/p>\n\n\n\n<p>&#8222;Dup\u0103 cum am observat pe parcursul anului 2023, <strong>pre\u021burile la chirii au continuat s\u0103 creasc\u0103, iar \u00een tandem cu acestea \u0219i evaziunea fiscal\u0103 \u00een r\u00e2ndul proprietarilor<\/strong>. Am v\u0103zut de multe ori pre\u021bul chiriei mai mic pe foaie dec\u00e2t \u00een realitate sau un anumit pre\u021b al chiriei plus cei 10% pl\u0103ti\u021bi de c\u0103tre chiria\u0219 suplimentar pentru a acoperi taxele, tot mai multe contracte de comodat semnate \u0219i tot mai mul\u021bi proprietari care solicit\u0103 chiria sub form\u0103 de cash&#8221;, ne-a declarat \u0219i Angelo Popescu, reprezentant al agen\u021biei King Imobiliare.<\/p>\n\n\n\n<p>&#8222;<strong>Tendin\u021ba de a nu \u00eenregistra contractele la ANAF va continua \u0219i \u00een 2024. Proprietarii \u00ee\u0219i \u00eengr\u0103desc singuri drepturile<\/strong>, dat fiind faptul c\u0103 un contract \u00eenregistrat este cu titlu executoriu, iar <strong>tot mai mul\u021bi chiria\u0219i nu vor mai avea siguran\u021ba zilei de m\u00e2ine<\/strong>. Cre\u0219terea num\u0103rului de contracte de tip comodat reprezint\u0103 un cumul de zero drepturi pentru chiria\u0219i \u0219i zero siguran\u021b\u0103, oric\u00e2nd ace\u0219tia put\u00e2nd fi evacua\u021bi&#8221;, a mai spus acesta.<\/p>\n\n\n\n<p>\u00cen opinia sa, re\u021binerea la surs\u0103 a impozitului \u00een cazul entit\u0103\u021bilor care au obliga\u021bia de a conduce eviden\u021b\u0103 contabil\u0103 este singurul lucru pozitiv care ar urma s\u0103 se vad\u0103 \u00een urma noilor modific\u0103ri pentru c\u0103 astfel &#8222;va fi luat\u0103 povara de pe spatele proprietarilor&#8221;. Tot \u00een opinia sa, \u00een cazul \u00eenchirierilor f\u0103cute cu un chiria\u0219 de tip persoan\u0103 juridic\u0103, cele mai multe contracte vor ajunge s\u0103 fie \u00eenregistrate la ANAF.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Cum ar putea evolua chiriile 2024?<\/strong><\/p>\n\n\n\n<p><a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/imoexpert\/imobiliare-ro-romanilor-care-au-o-nevoie-imobiliara-dar-inca-asteapta-o-scadere-dramatica-a-preturilor-le-sugeram-sa-ia-in-considerare-o-achizitie-in-2024-perspective-pentru-anul-viitor-mai-puti_db\/\">Cele mai noi date Imobiliare.ro<\/a> indic\u0103 o cre\u0219tere cu 26% a num\u0103rului de poten\u021biali chiria\u0219i la nivel na\u021bional \u0219i cu 35% \u00een cazul propriet\u0103\u021bilor din Capital\u0103. <\/p>\n\n\n\n<p>Cererea \u00een cre\u0219tere, al\u0103turi de o ofert\u0103 tot mai redus\u0103, a adus \u00een 2023 <strong>un avans cu circa 18% la nivel na\u021bional \u00een chiria medie solicitat\u0103 <\/strong>pentru un apartament cu 2 camere, aceasta situ\u00e2ndu-se \u00een jurul valorii de 450 euro\/lun\u0103.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"955\" height=\"597\" src=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/national-1.jpg\" alt=\"\" class=\"wp-image-68458\" srcset=\"https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/national-1.jpg 955w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/national-1-300x188.jpg 300w, https:\/\/www.imobiliare.ro\/imoexpert\/wp-content\/uploads\/2023\/12\/national-1-768x480.jpg 768w\" sizes=\"auto, (max-width: 955px) 100vw, 955px\" \/><\/figure>\n\n\n\n<p>\u00cen Bucure\u0219ti, o locuin\u021b\u0103 de acest fel a putut fi \u00eenchiriat\u0103 anul acesta cu 490 euro\/lun\u0103, cu 14% mai scump dec\u00e2t \u00een 2022.<\/p>\n\n\n\n<p>&#8222;<strong>Nu a\u0219tept\u0103m (n.r. anul viitor) o sc\u0103dere a valorii chiriilor solicitate de proprietari, mai degrab\u0103 o stabilizare a tarifelor de \u00eenchiriere, f\u0103r\u0103 a exclude posibilitatea unei cre\u0219teri minore<\/strong>, raportat\u0103 la evolu\u021bia general\u0103 a infla\u021biei&#8221;, spune CEO-ul Kastel Group.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Interes \u00een cre\u0219tere pentru colaborarea cu o agen\u021bie imobiliar\u0103 la \u00eenchiriere<\/strong><\/p>\n\n\n\n<p>Interac\u021biunea dintre proprietari \u0219i agen\u021biile imobiliare \u00eencepe s\u0103 se \u00eembun\u0103t\u0103\u021beasc\u0103 treptat, spune Christian Tudorache.<\/p>\n\n\n\n<p>&#8222;Cu siguran\u021b\u0103, pia\u021ba imobiliar\u0103 poate p\u0103rea o jungl\u0103, cu toate p\u0103r\u021bile implicate av\u00e2nd nevoi, a\u0219tept\u0103ri \u0219i frustr\u0103ri distincte.
