Ob\u021binerea st\u0103rii de drept asupra unei propriet\u0103\u021bi, al\u0103turi de \u00eenscrierea \u00een Cartea Funciar\u0103, <strong>este posibil\u0103 prin posedarea ne\u00eentrerupt\u0103 \u0219i public\u0103 timp de 5, 10, 20 sau 30 de ani<\/strong>, \u00een func\u021bie de tipul uzucapiunii.&nbsp;<\/p>\n\n\n\n<p>Uzucapiunea este o solu\u021bie pentru persoanele care au cump\u0103rat terenuri, case sau apartamente \u00een perioada comunismului, c\u00e2nd se interzicea tranzac\u021bionarea de imobile \u00eentre persoane fizice. Astfel, tranzac\u021bia nu se finaliza pe baza unui contract de v\u00e2nzare-cump\u0103rare, ci pe baza unei chitan\u021be. \u00cen aceast\u0103 situa\u021bie, cump\u0103r\u0103torul nu primea titlu de proprietate, deci nu era \u00eenscris \u00een Cartea Funciar\u0103 ca fiind proprietarul de drept. Prin urmare, o astfel de proprietate nu poate fi tranzac\u021bionat\u0103 mai departe.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u00cen alte situa\u021bii, uzucapiunea poate fi privit\u0103 ca o sanc\u021biune a pasivit\u0103\u021bii adev\u0103ratului proprietar pentru c\u0103 \u0219i-a abandonat bunul l\u0103s\u00e2ndu-l \u00een posesia altei persoane un timp \u00eendelungat, fapt ce conduce la prezum\u021bia c\u0103 nu \u0219i-l mai dore\u0219te. Alteori, imobilul poate fi ob\u021binut astfel, dac\u0103 proprietarul fie a decedat, fie a renun\u021bat la dreptul de a fi proprietar sau dac\u0103 bunul nu este \u00eenscris \u00een Cartea Funciar\u0103.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><span class=\"ez-toc-section\" id=\"Care_sunt_conditiile_dobandirii_unei_proprietati_fara_act\"><\/span>Care sunt condi\u021biile dob\u00e2ndirii unei propriet\u0103\u021bi f\u0103r\u0103 act?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Condi\u021biile pentru dob\u00e2ndirea unei locuin\u021be sau unui teren aflat \u00een folosin\u021b\u0103 difer\u0103 \u00een func\u021bie tipul de uzucapiune (<strong>tabular\u0103, extratabular\u0103, de scurt\u0103 sau de lung\u0103 durat\u0103<\/strong>). Iat\u0103 c\u00e2teva condi\u021bii generale care trebuie \u00eendeplinite:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Posesia bunului trebuie s\u0103 fie continu\u0103, public\u0103, util\u0103 \u0219i neviciat\u0103 (posesorul s-a comportat ca un adev\u0103rat proprietar, iar bunul nu a fost ob\u021binut prin violen\u021b\u0103);<\/li>\n\n\n\n<li>Posesorul s\u0103 fie de bun\u0103-credin\u021b\u0103 \u2013 pentru uzucapiunea de lung\u0103 durat\u0103 (30 de ani), \u00eens\u0103, aceast\u0103 condi\u021bie nu este necesar\u0103;<\/li>\n\n\n\n<li>Posesorul trebuie s\u0103-\u0219i fi \u00eenregistrat cererea de \u00eenscriere \u00een Cartea Funciar\u0103 \u00eenainte ca o alt\u0103 persoan\u0103 s\u0103 o fac\u0103;<\/li>\n\n\n\n<li>Posesia s\u0103 \u00eendeplineasc\u0103 termenul prev\u0103zut de lege: <strong>5 ani pentru uzucapiunea tabular\u0103<\/strong>, <strong>10 ani pentru cea extratabular\u0103<\/strong>, 10-20 de ani pentru uzucapiunea de scurt\u0103 durat\u0103 sau 30 de ani pentru cea de lung\u0103 durat\u0103.<\/li>\n<\/ul>\n\n\n\n<p>Uzucapiunea de scurt\u0103 \u0219i de lung\u0103 durat\u0103 apar\u021bin Vechiului Cod Civil, iar cea tabular\u0103 \u0219i cea extratabular\u0103 fac parte din Noul Cod Civil, care a intrat \u00een vigoare la 1 octombrie 2011. \u00cen func\u021bie de momentul \u00een care a \u00eenceput posesia (\u00eenainte sau dup\u0103 aceast\u0103 dat\u0103), cazul se va supune reglement\u0103rilor noului sau vechiului Cod Civil.&nbsp;<\/p>\n\n\n\n<p>Bunurile declarate inalienabile, cum ar fi cele care apar\u021bin fondului funciar de stat, nu pot fi uzucapate. De asemenea, nu po\u021bi dob\u00e2ndi dreptul de proprietate asupra unui imobil pe care \u00eel ai \u00een folosin\u021b\u0103 temporar cu titlu de chiria\u0219, comodatar, depozitar, locatar sau creditor gajist.<\/p>\n\n\n\n<p><strong>Nici dac\u0103 pl\u0103te\u0219ti impozitul nu \u00eenseamn\u0103 c\u0103 po\u021bi deveni automat proprietar.<\/strong> De\u0219i acest aspect poate fi luat \u00een considerare \u00een procesul de uzucapiune, nu este suficient pentru a ob\u021bine titlul de proprietate.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><span class=\"ez-toc-section\" id=\"Ce_pasi_trebuie_sa_parcurgi_pentru_a_deveni_proprietar_prin_uzucapiune\"><\/span>Ce pa\u0219i trebuie s\u0103 parcurgi pentru a deveni proprietar prin uzucapiune?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Pentru a deveni proprietar prin aceast\u0103 metod\u0103 este necesar s\u0103 parcurgi urm\u0103toarele etape:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Primul pas este s\u0103 iei leg\u0103tura cu un avocat specializat \u00een uzucapiune \u0219i s\u0103 deschizi un proces civil, prin depunerea unei cereri de chemare \u00een judecat\u0103.<\/li>\n\n\n\n<li>Pe l\u00e2ng\u0103 cererea de uzucapiune, va trebui s\u0103 ata\u0219ezi la dosar o serie de documente, cum ar fi documenta\u021bia tehnic\u0103 cadastral\u0103 a imobilului, anumite certificate eliberate de notar, prim\u0103rie \u0219i serviciul public comunitar local, extrasul de carte funciar\u0103.&nbsp;<\/li>\n\n\n\n<li>Nu \u00een ultimul r\u00e2nd, va fi nevoie s\u0103 incluzi \u00een proces cel pu\u021bin doi martori.&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>Pentru a afla cu certitudine c\u00e2t cost\u0103 procesul de uzucapiune este indicat s\u0103 consul\u021bi un avocat specializat \u00een uzucapiune.
