Ca s\u0103 po\u021bi preveni o situa\u021bie poten\u021bial problematic\u0103, e absolut critic s\u0103 ai c\u00e2t mai multe informa\u021bii despre cei cu care urmeaz\u0103 s\u0103 ai o colaborare.<\/p>\n\n\n\n<p>Pornind de la acest crez, activitatea \u00eentregii echipe din care fac parte, e centrat\u0103 pe asigurarea evit\u0103rii oric\u0103ror viitoare litigii pentru clien\u021bii no\u0219tri. Primul pas \u00een acest scop e chiar realizarea unei verific\u0103ri \u00een urma c\u0103reia preg\u0103tim un raport \u00een care avem \u00een vedere nu doar documenta\u021bia aferent\u0103 acelui proiect, ci \u00eencerc\u0103m s\u0103 ob\u021binem \u0219i c\u00e2t mai multe informa\u021bii din pia\u021b\u0103 \u0219i din surse oficiale despre acel dezvoltator.<\/p>\n\n\n\n<p><strong>\u00cencurajez orice persoan\u0103 interesat\u0103 s\u0103 achizi\u021bioneze un imobil, s\u0103 caute pe site-ul oficial al instan\u021belor de judecat\u0103 din Rom\u00e2nia (<a class=\"article-body-links\"href=\"http:\/\/www.portal-just.ro\">www.portal-just.ro<\/a>) dup\u0103 denumirea acelui dezvoltator, pentru a vedea dac\u0103 exist\u0103 sau nu litigii <\/strong>av\u00e2nd societatea respectiv\u0103 ca p\u00e2r\u00e2t \u0219i care este obiectul acelor dosare. Atrag \u00eens\u0103 aten\u021bia asupra faptului c\u0103 litigiile derulate \u00een fa\u021ba instan\u021belor arbitrale \u0219i a celor str\u0103ine nu pot fi verificate \u00een acest mod, astfel c\u0103 nu putem avea certitudinea lipsei oric\u0103ror litigii. Cu toate acestea, chiar dac\u0103 informa\u021biile ob\u021binute cu privire la litigiile \u00een care acel dezvoltator ar fi parte, nu sunt complete, \u00een situa\u021bia \u00een care exist\u0103 multe dosare av\u00e2nd societatea ca p\u00e2r\u00e2t pe site-ul instan\u021belor de judecat\u0103 de drept comun, ar fi bine s\u0103 aborda\u021bi proiectul cu precau\u021bie.<\/p>\n\n\n\n<p><strong><a class=\"article-body-links\"href=\"https:\/\/www.imobiliare.ro\/imoexpert\/alegerea-locuintei-doar-pe-baza-pretului-poate-avea-efecte-adverse-cum-alegi-corect-si-ce-documente-ceri-dezvoltatorului_db\/\" target=\"_blank\" rel=\"noreferrer noopener\">Cite\u0219te \u0219i: Alegerea locuin\u021bei doar pe baza pre\u021bului poate avea efecte adverse! Totu\u0219i, dac\u0103 societatea e activ\u0103 deja de mai mult\u0103 vreme pe pia\u021b\u0103, se pot observa m\u0103car valorile din perioada anterioar\u0103.<\/p>\n\n\n\n<p><strong>Se poate de asemenea ob\u021bine un certificat constatator al dezvoltatorului de la Oficiul Registrului Comer\u021bului (cel mai simplu este solicitarea certificatului online de pe site-ul oficial <a class=\"article-body-links\"href=\"http:\/\/www.myportal.onrc.ro\">www.myportal.onrc.ro<\/a>)<\/strong>, pentru a verifica cine sunt asocia\u021bii \u0219i administratorii acelei societ\u0103\u021bi, unde este sediul ei \u0219i care sunt obiectele de activitate autorizate.<\/p>\n\n\n\n<p>\u00cen plus, pentru a ne forma o imagine general\u0103 cu privire la reputa\u021bia respectivului dezvoltator, pot fi utile \u0219i<strong> rapoartele de bonitate emise de societ\u0103\u021bi specializate<\/strong> \u00een aceast\u0103 activitate.<\/p>\n\n\n\n<p>Fa\u021b\u0103 de resursele de mai sus, a\u0219a cum spuneam, sunt necesare \u0219i <strong>verific\u0103ri \u00een pia\u021ba relevant\u0103<\/strong>, acestea put\u00e2nd \u00eencepe cu simple discu\u021bii avute cu al\u021bi clien\u021bi, vecini ori dezvoltatori din zon\u0103. Orice informa\u021bie ob\u021binut\u0103 poate fi de ajutor.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Ce al\u021bi pa\u0219i urmez c\u00e2nd cump\u0103r o locuin\u021b\u0103 aflat\u0103 \u00een construc\u021bie sau la stadiul de proiect?<\/strong><\/p>\n\n\n\n<p><em><strong>R\u0103spuns Alexandra Jivan, Avocat Partener LEGAL FOR:<\/strong> <\/em>Trebuie verificat\u0103 \u00eentreaga documenta\u021bie existent\u0103 \u0219i cea care st\u0103 la baza<strong> dob\u00e2ndirii terenului ori cl\u0103dirii deja edificate<\/strong> (c\u00e2t mai mul\u021bi pa\u0219i \u00een spate),<strong> normele de urbanism aplicabile acelei zone <\/strong>(hot\u0103r\u00e2rea de aprobare a PUZ-ului, regulamentul de urbanism aplicabil, documenta\u021bia tehnic\u0103 \u00een temeiul c\u0103reia s-a emis autoriza\u021bia de construire etc. \u0219i solicitat un certificat de urbanism nu mai vechi de 30 de zile) \u0219i bine\u00een\u021beles <strong>analizate cu mare aten\u021bie documentele ce urmeaz\u0103 s\u0103 fie semnate pentru achizi\u021bie<\/strong>, adic\u0103 promisiunea \u0219i contractul.<\/p>\n\n\n\n<p>Mai mult, atrag aten\u021bia asupra faptului c\u0103 <strong>existen\u021ba unei c\u0103r\u021bi funciar\u0103 care nu are sarcini \u00eenscrise nu reprezint\u0103 o garan\u021bie suficient\u0103 pentru a se considera c\u0103 respectivul imobil nu are o situa\u021bie juridic\u0103 mai complicat\u0103<\/strong>.
