unilateral\u0103.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Este posibil ca ulterior \u00eencheierii precontractului, una dintre p\u0103rti s\u0103 se r\u0103zg\u00e2ndeasc\u0103, renun\u0163\u00e2nd la \u00eendeplinirea obliga\u0163iilor asumate, situa\u0163ie \u00een care se pune problema m\u0103surilor sau sanc\u0163iunilor la care cealalt\u0103 parte poate recurge.<\/p>\n<p>\u00cen cazul \u00een care p\u0103r\u0163ile au prev\u0103zut expres \u00een antecontract sanc\u0163iunile ce pot fi aplicate \u00een cazul \u00eenc\u0103lc\u0103rii obliga\u0163iilor asumate, se vor aplica acele prevederi, av\u00e2nd \u00een vedere c\u0103, potrivit art. 969 cod civil, conven\u0163iile legal f\u0103cute au putere de lege \u00eentre p\u0103r\u0163ile contractante, fiind deci obligatorii.<\/p>\n<p>De regul\u0103, \u00een precontractele de v\u00e2nzare cump\u0103rare se prevede c\u0103 dac\u0103 se r\u0103zg\u00e2ndesc, promitentul cump\u0103r\u0103tor va pierde avansul achitat, iar dac\u0103 promitentul v\u00e2nz\u0103tor va refuza \u00eenstr\u0103inarea bunului, acesta va restitui dublul avansului primit.<\/p>\n<p>\u00cen cazul \u00een care p\u0103r\u0163ile nu au fost suficient de prev\u0103z\u0103toare \u00eenc\u00e2t s\u0103 determine expres urm\u0103rile \u00eenc\u0103lc\u0103rii precontractului, se aplic\u0103 dispozi\u0163iile generale ale legii civile.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Se_poate_ajunge_in_justitie\"><\/span>Se poate ajunge \u00een justi\u021bie<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Av\u00e2nd \u00een vedere dispozi\u0163iile art. 1073 Cod civil, potrivit c\u0103ruia creditorul are dreptul la \u00eendeplinirea \u00eentocmai a obliga\u0163iei \u015fi \u00een caz contrar are dreptul la dezd\u0103unare, partea \u00een culp\u0103 poata fi obligat\u0103, \u00een justi\u0163ie, la executarea obliga\u0163iei asumate.<\/p>\n<p>Astfel, \u00een cazul \u00een care v\u00e2nz\u0103torul (sau promitentul v\u00e2nz\u0103tor) nu mai dore\u015fte \u00eenstr\u0103inarea bunului \u00een condi\u0163iile precontractului, cump\u0103r\u0103torul (sau promitentul cump\u0103r\u0103tor) are dou\u0103 op\u0163iuni. El poate s\u0103 solicite instan\u0163ei de judecat\u0103 pronun\u0163area unei hot\u0103r\u00e2ri care s\u0103 \u0163in\u0103 loc de v\u00e2nzare cump\u0103rare, urm\u00e2nd a consemna pre\u0163ul v\u00e2nz\u0103rii \u00eentr-un cont la dispozi\u0163ia v\u00e2nz\u0103torului. \u00cen cazul \u00een care cump\u0103r\u0103torul nu opteaz\u0103 pentru aceast\u0103 variant\u0103 (pentru c\u0103 fie v\u00e2nzarea nu mai este posibil\u0103, bunul fiind \u00eenstr\u0103inat c\u0103tre un ter\u0163, fie nu mai este dorit\u0103), el poate alege s\u0103 oblige promitentul v\u00e2nz\u0103tor la restituirea avansului primit \u015fi la plata suplimentar\u0103 de daune interese.<\/p>\n<p>\u00cen situa\u0163ia \u00een care cump\u0103r\u0103torul nu mai dore\u015fte achizi\u0163ionarea bunului, promitentul v\u00e2nz\u0103tor poate ob\u0163ine de la acesta daune interese.
