{"id":806,"date":"2008-11-18T17:02:12","date_gmt":"2008-11-18T14:02:12","guid":{"rendered":"https:\/\/www.imobiliare.ro\/imoexpert\/?p=806"},"modified":"2008-11-18T17:02:12","modified_gmt":"2008-11-18T14:02:12","slug":"obligatiile-locatorului-in-cazul-contractului-de-inchiriere","status":"publish","type":"post","link":"https:\/\/www.imobiliare.ro\/imoexpert\/obligatiile-locatorului-in-cazul-contractului-de-inchiriere_db\/","title":{"rendered":"Obliga\u0163iile locatorului \u00een cazul contractului de \u00eenchiriere"},"content":{"rendered":"<p>Obliga\u0163iile locatorului au la baz\u0103 principiul potrivit c\u0103ruia acesta trebuie s\u0103 asigure locatarului folosin\u0163a pa\u015fnic\u0103 \u015fi netulburat\u0103 a bunului \u00eenchiriat \u015fi au izvorul \u00een dispozi\u0163iile codului civil \u015fi ale legii 114\/1996, p\u0103r\u0163ile put\u00e2nd stabili, pe cale conven\u0163ional\u0103 \u015fi alte obliga\u0163ii.<\/p>\n<p>Astfel, potrivit dispozi\u0163iilor art. 1420 Cod civil, locatorul este obligat :<\/p>\n<ul>\n<li> s\u0103 predea locatarului lucrul \u00eenchiriat sau arendat<\/li>\n<li> s\u0103 men\u0163in\u0103 lucrul \u00een stare de a se putea servi la utilizarea pentru care a fost \u00eenchiriat sau arendat,<\/li>\n<li> s\u0103 asigure folosin\u0163a ne\u00eempiedicat\u0103 a bunului pe toat\u0103 durata loca\u0163iunii.<\/li>\n<\/ul>\n<p>Din obliga\u0163ia de men\u0163inere a bunului \u00een stare de folosin\u0163\u0103 deriv\u0103 \u015fi obliga\u0163ia de garantare a locatarului pentru toate stric\u0103ciunile sau viciile bunului \u00eenchiriat sau arendat \u015fi de a-l desp\u0103gubi pe acesta pentru orice daun\u0103 suferit\u0103 datorit\u0103 defectelor sau viciilor (art. 1422 cod civil).<\/p>\n<p>\u00cen cazul \u00een care \u00een timpul loca\u0163iunii, bunul \u00eenchiriat se stric\u0103 \u00een totalitate sau devine ne\u00eentrebuin\u0163abil de c\u0103tre locatar, contractul de \u00eenchiriere se consider\u0103 de drept reziliat, \u00eens\u0103 pentru aceasta trebuie s\u0103 se constate imposibilitatea \u00eentrebuin\u0163\u0103rii bunului fie de c\u0103tre p\u0103r\u0163i, de comun acord, fie prin intermediul instan\u0163ei de judecat\u0103.<\/p>\n<p>Dac\u0103 deteriorarea bunului este par\u0163ial\u0103, locatarul are posibilitatea de a solicita reducerea chiriei sau rezilierea contractului.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Obliga\u0163iile locatorului au la baz\u0103 principiul potrivit c\u0103ruia acesta trebuie s\u0103 asigure locatarului folosin\u0163a pa\u015fnic\u0103 \u015fi netulburat\u0103 a bunului \u00eenchiriat \u015fi au izvorul \u00een dispozi\u0163iile codului civil \u015fi ale legii 114\/1996, p\u0103r\u0163ile put\u00e2nd stabili, pe cale conven\u0163ional\u0103 \u015fi alte obliga\u0163ii.
